What is a Wrongful Death Claim and How Can it Help Survivors?

The unexpected loss of a close relative in a motor vehicle collision may be painful and devastating in various ways. That is why California law protects the interests of surviving family members who suffer the loss of a loved one due to someone else’s negligence or carelessness. Remember that wrongful death cases go beyond financial compensation. They are about accountability and justice. These cases send the message that such behavior will not be tolerated in the community. Making an example out of the at-fault party may provide survivors with a sense of closure and justice.

Priority for filing a case for wrongful death generally falls on the spouse, domestic partner, or children of the individual who was killed in the accident, according to CCP 377.60. This is followed by next-of-kin if no surviving spouse, domestic partner, or children exist. Eligible claimants may include the deceased’s parents, putative spouse, and other family members who depended on them for financial support. Family members who meet the filing criteria must bring a case no later than two years from the date of loss. This must be done if it is not settled within the two-year statute of limitations.

A claim for wrongful death requires demonstration through clear and compelling evidence that another party was responsible for the loss of life. A successful case usually covers economic and non-economic damages for funeral expenses, end-of-life care (via survival action), loss of income, loss of future financial support, loss of valuable household services, loss of companionship, mental anguish, and more. Punitive damages are reserved for cases where egregious conduct or an extreme disregard for safety or human life occurred. In a fatal car accident case, this may include DUI or excessive speeding.
