What is a Personal Injury Claim?

A severe traffic collision may occur in the Fremont area and lead to traumatic injuries. These may range from lacerations and contusions to bone fractures and traumatic brain injuries. When an individual gets injured in a crash in California through no fault of their own, the injured party may file a claim with the other side’s insurance carrier to seek reimbursement for damages incurred. To bring a successful case forward, there must be evidence that clearly shows that the other party was negligent and that their actions led to the incident that caused harm to the claimant. Evidence may include police reports, eyewitness accounts, medical records and summaries, video surveillance footage, and more.

Motor vehicle collisions may occur for a wide array of reasons. They may happen when a driver fails to follow the rules of the road, like following another vehicle too closely, speeding, and running a posted stop sign or traffic light. In other situations, car wrecks may occur when a motorist is distracted from the use of a cell phone, failing to yield the right of way to others, or driving under the influence of drugs or alcohol. In either of these cases, it may constitute driver negligence and an injured party may have grounds for a personal injury claim.

Car wrecks may result in traumatic injuries that may require weeks, months, or even years of ongoing medical care. In addition, an injured party may need to take time away from work to recover from accident-related injuries. This may lead to a considerable loss of earnings in the process. Fortunately, these losses and others may be recoverable through a bodily injury claim. As part of the injury case, a claimant may seek reimbursement for pain and suffering, diminished earning capacity, lost earnings, costs of past and future treatment, and more.
