Can a Parent Seek Compensation on Behalf of an Injured Child?

As parents, we want the best for our children. When they are put in harm’s way through no fault of their own, it can be painful and devastating. Traumatic injuries to a child from a pedestrian accident may require extensive treatment. In a personal injury claim, a parent may seek financial compensation for past and future costs of medical treatment, mental anguish, expenses for vehicle and household modifications for the accommodation of the child’s injuries, bills for in-home care, and pain and suffering. These cases are generally brought against at-fault parties and their insurers. However, there are some unique situations where the parent of an injured child will have to file an uninsured or underinsured motorist claim if the other side has insufficient or no liability coverage. UM coverage may also be utilized in the case of a hit-and-run accident.

Remember that a different statute of limitations applies to personal injury cases involving children. The filing deadline for children is two years from the date of their 18th birthday. From that date, a lawsuit must be filed within the two-year period if the claim is not settled with the insurer within that time. While this may seem like ample time, keep in mind that evidence may disappear as time passes. Therefore, it is essential to work with an accident attorney that has years of experience handling cases on behalf of parents of injured children. A lawyer will have the resources to work with private investigators to track down suspect drivers involved in hit-and-run accidents. When searching for a Modesto pedestrian accident attorney, you should consider one that has the dedication, compassion, and care.
