smokedetectorPersonal injury and/or death can occur due to negligence related to installation and/or maintenance of smoke alarms and sprinkler systems.  We often hear in the news terrible stories of a family living in an apartment suffering injuries or death due to the absence of working smoke detectors.  It can be easily assumed that in all such cases there follows a lawsuit against the landlord, apartment owner, and/or the maintenance staff.

While cases such as the above capture the public’s attention, there are many other ways in which a finding of negligence could attach to a responsible party.  They include, but are not limited to:

California residents leads the nation in hot tub ownership.  Knowing that, it is therefore no surprise that statistically Californian’s are also three times more likely to drown in a hot tub than residents of any other state.

Despite California being the leading owners of hot tubs a study prepared by Scripps Howard News service reviewed the mortality records from the years of 1999 to 2003 and found that states such as Wyoming and New Mexico had an unusually high reporting of death due to drownings.  In most of these hot tub fatalities, alcohol was involved.

With the days getting warmer, many Northern Californians’ thoughts turn to summer and the plethora of outdoor activities available in our area, including rafting on the American River.  While the immediate Sacramento region features a rather mild experience from the university area to Fair Oaks that is popular with college-aged rafters looking for more of a party atmosphere, we are not far from the Middle Fork, which provides a more exciting experiencing – including Class II & Class III rapids and a few exhilarating Class IV drops.

The high cost of TENS unit seen by many personal injury clients.  Some clients involved in a collision will be seen by their physician and will be prescribed physical therapy and/or a TENS unit. A TENS (Transcutaneous electrical nerve stimulation) unit is small portable battery operated device with electrodes to attach to the skin in the area where the source of pain is located. The unit sends an electrical signal to relieve pain.

Before your doctor orders your TENS unit or you sign an agreement to purchase one, find out what you would be paying for it. I have seen instances in which a provider has charged a patient an exuberant amount for a TENS unit ($650.00) that you could purchase yourself on line directly from a medical equipment supplier for under $100.00.

As an experienced personal injury lawyer since 1982, it gives me no pleasure to write the above headline.  Many of my friends (indeed my family) are cops, and overall they do a great job protecting us from the bad guys.

Nonetheless, when I see a practice everyday that hurts my clients, I need to speak up. Lately, throughout Sacramento, officers have been coming to accident scenes and failing to write a police report.
