Accident Along Carson Road Causes Pedestrian Fatality

A pedestrian fatality occurred near Camino in El Dorado County on February 8 after a hit-and-run driver struck a minor. The driver has since turned himself in to authorities and was identified as a resident of Pollock Pines, age 23. He is currently at the El Dorado County Jail, facing charges of DUI and vehicular manslaughter.

Driver Charged in Teen’s Death

The pedestrian fatality accident occurred shortly after 4:00 p.m. when the teenage girl was walking with a friend on Carson Road, east of Barkley Road. She was killed by a driver in a Honda CR-V, whose vehicle left the roadway onto the shoulder, hit the minor then fled from the scene. When officers with the California Highway Patrol (CHP) arrived at the accident site, they discovered that the young pedestrian had died from her injuries.

Neighbors Comfort Teen

Neighbors living nearby reported hearing a loud noise and went out and saw the injured minor. The husband said the young girl was never alone. He and his wife stayed with her as first responders performed CPR. The accident reportedly happened in the driveway of this neighbor’s home.

Lack of Lighting and Sidewalks in a Pedestrian Fatality

The neighbors said the street is very dark, and there are no sidewalks. Many accidents had occurred along the road in front of their home before the pedestrian fatality. The neighbor’s wife said it should not take a child’s death to make the community safer. She suggested that by adding a sidewalk to one side of the road, no one would have to go through what had happened that day. They offered their sincere condolences to the young girl’s family and just wanted them to know she had not been alone at the time of the accident.

Facing the Loss of a Loved One

Losing a family member to a wrongful death is a horrific experience, but even more so when it is your child. The last thing the family is probably thinking about is placing a wrongful death claim, but by doing so, they can hold the at-fault driver responsible for their actions. Although nothing will ever replace their loved one and it won’t help ease their grief, it can help them achieve a sense of justice for themselves and their daughter.

Government Negligence as a Cause of Wrongful Death

Besides filing a wrongful death claim against the negligent driver, the family may be able to pursue a lawsuit against the government entity in charge of roadway maintenance. Municipal agencies are responsible for tending to streetlights and installing sidewalks when needed. They are charged with keeping the roadway safe for pedestrians and motorists alike. When they fail that duty and people are injured, a lawsuit can be filed against them.

A claim against a government agency follows a different set of rules. Most importantly, the time limit in which the claim must be filed is considerably less than in other personal injury cases. If the deadline is not met, the case will not be heard. Your Placerville wrongful death lawyer will ensure that all documents are filed in a timely manner.
