What if the Other Driver Has Little to No Insurance Coverage?

Getting into a motor vehicle collision can be stressful and challenging, to say the least. Finding out that the driver responsible for the incident did not have auto insurance or has limited liability coverage may leave you unsure of how to proceed in your situation. This is especially true when serious injuries are involved. An accident attorney can help you with the nuances of your personal injury case and seek maximum financial recovery on your behalf. That will start with a review of your auto insurance policy to determine whether your uninsured and underinsured motorist coverage will come into play up to the plan’s limits.

Different from bodily injury liability coverage, UM and UIM are intended to protect you in case the other side does not have enough liability coverage or no auto insurance at all to pay for damages incurred. By California law, drivers must carry $15,000 for injury or death to one party, $30,000 for injury or death to more than one person, and $5,000 in property damage coverage. This type of protection is optional to carry in California. However, it is recommended for peace of mind.

While the state minimum auto insurance limits may seem like ample coverage, the reality is that it may not be enough to cover a car accident involving multiple injured parties. The at-fault party’s policy limits are allocated among all injured individuals. That is why it is a good idea to carry UM and UIM coverage in California. Our legal team recommends carrying at least $100,000 per person/$300,000 for more than one party in UM and UIM protection.
