What is Involved in the Wrongful Death Claims Process?

When an individual loses their life in an accident due to the negligence of another party or entity, the surviving family members of the decedent may be able to bring a wrongful death claim. This type of civil case allows survivors to be compensated for the economic and non-economic damages related to the loss of a loved one. Understanding how this type of claim may be brought forward, the challenges that may arise in the process, and how it may assist a family is essential. For instance, if a single-vehicle accident resulted in a fatality, the family of the decedent may have grounds to bring a claim against various parties.

A single-vehicle accident may be the result of reasons that are not immediately apparent, such as a poorly designed or maintained road and a defect in the motor vehicle that was involved. In the former, a government entity may be held liable for the failure to maintain a public road that was found to have contributed to a fatal crash. Conversely, there are times when a vehicle part is defective, and the automaker may recall it. In some situations, the recall may not be put in place until the motorist was involved in a crash and the issue has been reported. Going against an automaker or a government entity in a wrongful death case is not always easy, but having the right accident attorney at your side may make a world of difference in the outcome of the claim.

Retaining legal counsel immediately after a fatal car accident is crucial as there may be specific filing criteria and deadlines that must be met to protect the case. Pursuant to the California Code of Civil Procedure Section 335.1, a lawsuit must be filed within two years of the date of a loved one’s death. There are factors that may influence the statute of limitations in a wrongful death case. For instance, if the claim involves a government entity, a notice of claim must be filed no later than six months or 180 days from the fatal incident date. This is by the California Government Code Section 911.2. Therefore, it is advisable to discuss the specifics of the case with an experienced accident attorney immediately to determine when it should be filed.
