Driver Arrested in Chico Pedestrian Crash for Suspected DUI

The driver remained at the scene of the Chico pedestrian crash and was cooperating with officers. However, after taking a field sobriety test, he was determined to be driving under the influence of alcohol and placed under arrest. The intersection where the accident occurred remained shut down for about 3.5 hours as an investigation was conducted. That investigation is ongoing.

Injury Risks Associated with Pedestrian Accidents

A Chico pedestrian’s injuries can vary based on the vehicle that struck them and its size and speed. A high impact speed may cause pedestrians to land on a vehicle’s hood or windshield or hit the ground after flying through the air. There are a variety of injuries that can be sustained in pedestrian accidents, including bruises, severe bone fractures, and traumatic brain injuries. In addition, the faster the vehicle goes, the greater the chances of the pedestrian dying in an accident.

An Accident Lawyer’s Approach to Pedestrian Injuries

Personal injury lawyers offer free case reviews following a Chico pedestrian crash so that injured pedestrians can determine whether they have grounds to file a claim. After the lawyer determines the cause of the accident, their investigators gather evidence to support the claim against the negligent party. The lawyer uses that evidence to support the client’s compensation claim.

In most cases, the injury lawyer negotiates with the at-fault driver’s insurance company on your behalf. The lawyer can, however, take the case to civil court if the insurance company does not offer a fair settlement.

Negligent Drivers’ Recoverable Compensation for Pedestrians

The amount of compensation a pedestrian is entitled to after being hit by a negligent driver in Chico may be a question on their mind. Motorists and other entities can be held responsible for economic and non-economic damages if they cause an accident. Additionally, punitive damages may be available in cases of egregious negligence or intentional striking of the walker.

In economic damages, a monetary value is assigned, such as medical bills and wages lost by the injured party due to incapacitation. Unlike economic damages, noneconomic damages include pain and suffering, emotional distress, and loss of enjoyment of life due to the injury preventing them from participating in previous activities.

The amount of noneconomic damages (pain and suffering) that an injured person in California can recover is unlimited. An injury significantly impacting your life could result in a large compensation award. Discover what compensation you might be entitled to by contacting an experienced personal injury lawyer.
