Why Your Family Might Want to File a Wrongful Death Claim

The sudden loss of a family member leaves them grappling not only with the finality but with a sense of unresolved grief and injustice. Filing a wrongful death claim can provide a pathway for families to seek closure and accountability and alleviate some of the emotional burden. In addition, it helps the family avoid the financial distress that often accompanies a sudden death.

Filing a Wrongful Death Lawsuit

Immediate family members, including spouses and children, can initiate a wrongful death lawsuit when a loved one dies due to someone else’s carelessness or negligence. Parents and siblings can also bring forward a claim if there are no surviving spouses or children. Additionally, the estate administrator holds the right to file. However, the law permits only one lawsuit for each case.

Damages That Are Recoverable in a Wrongful Death

Recoverable damages in a wrongful death claim include the cost of the funeral, burial or cremation and wages the decedent would have earned until they reached retirement age. The surviving spouse can recover compensation for their loss of affection, love and consortium. Children in the family can recover compensation for the loss of thair parent’s guidance and nurturing.

The loss of household assistance is recoverable, which are areas where the deceased helped around the home. Examples include auto and lawn care, childcare, laundry, cooking, and many others. In some families, the loss of inheritance may be recoverable. Your injury lawyer can offer further explanations of recoverable damages in a wrongful death claim and will help you and protect your rights.
