One Hospitalized After Car Crash in Merced County
The California Highway Patrol (CHP) reported that one party was hospitalized after a recent car crash near Gustine in Merced County. The two-vehicle accident occurred shortly before 5:00 a.m. on Bambauer Road at Highway 33, just north of the city of Gustine. The CHP said that a 46-year-old Gustine resident was driving a 2003 Ford F-350 northbound on Highway 33. At the same time, a 50-year-old Gustine resident was behind the wheel of a 2017 Chevrolet Equinox traveling eastbound on Bambauer Road. The driver of the Chevrolet was taken by ambulance to Emmanuel Medical Center in Turlock for treatment of hand bruising and complaint of head pain. Updates regarding their condition were not immediately available.
Types of Compensation Available After an Auto Collision
Dealing with the aftermath of a car accident can be complicated. You may have been forced to miss time at work and may have medical expenses mounting as you recover from your injuries. Under California law, people injured in motor vehicle collisions have a legal right to seek financial compensation for their economic and non-economic damages. These include past and future medical bills, lost earnings, loss of future earning potential, loss of consortium, emotional distress, permanent disability, and pain and suffering. How Long Do You Have to File a Personal Injury Claim in California?
If you were injured after a car accident in Merced County, you must act quickly to protect your legal rights to seek financial compensation. Evidence may be lost or destroyed over time, and memories of the incident may fade, making it challenging to determine and prove liability on the part of the negligent driver. That is why it is essential to work with an experienced Merced injury attorney. A lawyer who is experienced in handling personal injury accident cases like yours will ensure all evidence and documents relevant to your claim are gathered and preserved to present to an insurance company for reimbursement of losses incurred. If a settlement cannot be reached with the insurer within California’s two-year statute of limitations, your attorney will file a lawsuit to protect your case from being dismissed by the court for failure of meeting the California Code of Civil Procedure Section 335.1 on statutory deadlines.
Is There Enough Auto Insurance to Cover Injuries and Damages?
Some car accidents have the potential to result in serious injuries and damages. If the driver responsible for the crash does not have insurance or carries state minimum bodily injury liability coverage, this may put the person injured by their negligence in a financial predicament. In such a situation, you may be able to seek recourse through an uninsured/underinsured motorist coverage claim filed with their insurance company for recovery of damages incurred. While the case will be handled by their insurer, this does not mean that they will be fair when it comes to offering the full compensation they need to cover their losses.
