Woman Killed in Highway 99 Rollover in Modesto

A woman was killed in a rollover accident on Highway 99 in north Modesto on the afternoon of Saturday, November 21, 2020. The fatal car accident in Modesto occurred on the northbound lanes of SR-99 near Beckwith Road, according to the California Highway Patrol (CHP). A driver of a white Pontiac sedan reportedly lost control by veering to the left across all lanes of traffic and colliding with the center divider. The impact propelled the vehicle over the barrier and came to a rest on its roof along the southbound side of State Route 99. First responders said that the two occupants of the Pontiac were pinned inside. A female passenger was taken to the hospital for treatment of mild to moderate injuries. Sadly, the female driver was pronounced deceased at the scene. The identities of those involved in the fatal Highway 99 car accident have not yet been released. However, CHP traffic officials said the two parties were from Stockton. Additional details on the incident were not immediately available.

Loss of a Loved One

Motor vehicle collisions often result in traumatic consequences for those involved. In some severe cases, car accident injuries may result in the loss of a loved one. When this happens, the family of the decedent may bring a wrongful death case against the party responsible for their loss and grief. In a single-vehicle accident, it is often assumed that the driver involved in the incident was at-fault. However, that is not always the case. A Modesto car accident lawyer may hold other parties responsible for the loss of a loved one in a single-vehicle crash, such as a government entity or automaker. In a single-car accident where no one else was involved, a government agency may be held liable for poor road conditions that contributed to the incident through a government entity claim. Keep in mind that these cases are subject to a six-month statute of limitations under the California Government Code Section 911.2. If a fatal single-car collision involved a rollover and a vehicle that failed to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance, the car manufacturer may be held financially accountable for wrongful death losses incurred, which is why it is critical to preserve the vehicle after a rollover.

What Must a Family Prove in a Wrongful Death Claim?

To recover wrongful death damages for the loss of a loved one, the family must prove that the at-fault party engaged in negligent actions. Four elements of negligence comprise a wrongful death claim. In the first element, the surviving family member must show that the individual owed their loved one a duty of care. The second element requires the survivor to demonstrate that the person failed to meet this duty of care, and in the third element, it must be shown that the breach of the duty of care was the direct cause of the loved one’s wrongful death. The family must prove intangible and financial losses through monetary damages in the fourth element, one of the most contested elements of a wrongful death car accident case.
