A 44-year-old Merced woman was left in critical condition after getting injured in a bicycle accident in the Merced area on April 4, 2021. The incident occurred at G and 23rd Streets. The driver involved in the bicycle accident remained at the scene and cooperated with local law enforcement. Further details on the incident were not immediately available.

Protect Your Legal Rights After a Bicycle Accident

Under California law, both drivers and cyclists owe specific duties and hold responsibilities to one another when sharing the road. However, not all drivers operate vehicles safely around cyclists, often resulting in serious collisions.

If you were recently involved in a bicycle accident caused by a negligent driver, you may be concerned about who is going to pay your medical expenses and lost wages. The last thing you want to deal with during this difficult time is being taken advantage of by the insurance company representing the at-fault party or even your own.

If you do not protect your rights, you may lose out on the compensation you need and deserve. You need a Merced personal injury lawyer with the experience, skills, and resources necessary to win your case.

Potential Damages in a Personal Injury Case

The types of damages available in a personal injury claim will depend on the facts and circumstances of the case. Injured parties may recover economic and non-economic damages for past and future medical expenses, wage loss, lost future earnings, emotional distress, pain and suffering, and other losses.

In some extreme bicycle accident cases, injured parties may seek punitive damages from negligent drivers as a way of punishing them for their egregious conduct.

Is There Enough Insurance for a Merced Bicycle Accident Case?

In personal injury cases arising from bicycle accidents, the question of whether there is enough insurance to cover resulting damages often comes to mind. The reason being that the losses involved with catastrophic injuries in cycling crashes are often high.

When a cycling crash is caused by a negligent driver with little to no bodily injury liability coverage, there may be recourse for injured cyclists. If the injured party had an auto insurance policy with uninsured/underinsured motorist coverage (UM/UIM), a claim for damages may be filed against that insurance plan. Conversely, if the injured cyclist did not have car insurance but lived with a relative who carries this type of coverage, a UM or UIM claim may be filed against that policy. This is a viable option for recovery so long as the cyclist was not listed as an excluded member of the plan.
