The accident, which left the vehicle overturned and blocking the roadway, required assistance from the local Fire Department as parties were initially trapped inside. Vehicle Passenger Expires in Wheatland Fatal Accident
Preliminary reports confirmed the driver was walking and talking, but tragically, another individual did not survive the crash. The County Coroner was summoned to the site, and the CHP traffic collision unit is investigating the cause of the accident.
Responsibility of the Driver
A driver is responsible for the safety of their passengers. If they fail in that duty and a passenger dies as a result of a collision, the deceased’s family may file a claim for wrongful death. They can recover the end-of-life expenses, wages the deceased would have earned until retirement age, and compensation for their personal loss.
Fatal Rollovers Caused by Poor Road Maintenance
While driver error is a common factor in fatal rollovers, other causes can significantly contribute to these tragic accidents. Poor road conditions, such as uneven surfaces, potholes, or improperly banked curves, can destabilize a vehicle, making it more prone to rolling over. When road upkeep causes a fatal accident, the government entity in charge may be held liable. Because the statute of limitations to file this type of claim is merely six months, contacting a wrongful death attorney for help may be advisable.
Auto Defects May Lead to a Fatal Rollover Accident
Vehicle design also plays a crucial role; cars with a higher center of gravity, such as SUVs and pickup trucks, are more susceptible to rollovers in a Wheatland fatal accident, especially during sharp turns or sudden maneuvers. Additionally, defective auto parts can cause brakes to fail, the accelerator to stick or other mechanical problems that can lead to a loss of control, increasing the likelihood of a rollover. In these cases, a product liability claim may be placed against the manufacturer and others in the production line. However, it is essential to retain the vehicle so it can be checked for defects to prove fault.
