Details on the Vehicle That Crashed into a Modesto Family Home

A preliminary report revealed that a car allegedly crashed through the garage door of the family home and came to a rest in the walls of a bedroom. A 10-year-old girl was sitting in the bedroom when the incident occurred, a family member said.

The father of the child found her beneath debris and was bleeding from her forehead. She was transported to Memorial Medical Center in Modesto by ground ambulance. Crews later requested an air ambulance to take the juvenile to Valley Children’s Hospital in Madera.

The driver of the involved vehicle, an elderly woman, reportedly suffered from a medical issue, according to the Modesto Police Department. Additional information on the crash was not immediately available.

Can I File a Bodily Injury Claim on Behalf of My Injured Child?

A personal injury claim brought on behalf of a minor child may be challenging and complex. Such cases generally arise when a juvenile suffers injuries in an accident due to the carelessness or negligence of another party, like a motor vehicle collision. The minor child may sustain physical injuries and mental anguish, requiring ongoing medical treatment and therapy to help them recover from the incident.

When this occurs, the child’s parents or legal guardians may file a claim for bodily injury on behalf of the injured minor child to seek compensation for economic and non-economic damages. This may include financial and intangible losses like pain and suffering and medical expenses. In some cases, the parents or legal guardians may seek reimbursement for future damages if an accident-related injury results in permanent disability for the minor child.

It is essential to note that personal injury cases involving minor children are usually subject to different legal procedures and rules than those of adults. For instance, the two-year statute of limitations may be tolled in the case of an injured juvenile. This means that the injured child has two years from their 18th birthday to file for personal injury in civil court. For more information, contact an experienced injury lawyer near you.
