Two Workers Hurt in Antioch Pedestrian Accident

The Antioch Police Department (Antioch PD) responded to a report of two workers hurt in a pedestrian accident on Thursday, September 17, 2020. The injury incident occurred along the 3100 block of Garrow Drive. A preliminary report by Antioch PD suggested that a driver reportedly crashed into two people who were working on the side of the road. One worker suffered a hip injury while the other sustained a severe head injury. A medical helicopter was requested at the scene of the pedestrian accident to transport the two parties to the hospital. Officials also reported that the driver of the vehicle involved in the crash was suspected of being under the influence of drugs or alcohol. No other details about the collision were immediately available.

Types of Personal Injury Compensation Available in a Pedestrian Accident Case

A pedestrian accident may have devastating effects on you and your family. You may face years of recovery and mounting medical expenses because of the serious injuries you have suffered. When the incident was caused by someone else’s negligence, you deserve justice and financial compensation to bring some peace of mind and take any burdens off your shoulder. Regardless of the types of injuries you have suffered in your accident, the goal of our Antioch personal injury attorneys is to recover the compensation you rightfully deserve for economic and non-economic damages, such as:

  • Past and future costs of medical treatment related to the pedestrian accident
  • Lost wages and diminished earning capacity due to the severity of injuries suffered in the vehicle versus pedestrian crash
  • Disfigurement or scarring, including the costs of cosmetic surgery to repair any scars from pedestrian injuries and other forms of therapy and rehabilitation
  • Pain and suffering for the mental harm and physical injuries sustained in a pedestrian collision

Is There Enough Insurance?

When a pedestrian accident involves more than one party, there may be an issue regarding the amount of bodily injury liability coverage available. Fortunately, your own insurance policy may come into play when the driver responsible for the pedestrian accident has insufficient coverage or none at all. This is possible so long as you carry uninsured/underinsured motorist coverage. Uninsured motorist coverage may be used when it has been determined that the at-fault party has no insurance, and underinsured motorist coverage may pay for damages not fully paid by the negligent driver’s insurer. How an Antioch Personal Injury Attorney Can Help After a Pedestrian Accident

Personal injury law in California requires a claimant to prove negligence on the part of the at-fault party to be successful in an accident case. One of the elements of negligence in a personal injury claim is the breach of duty that was owed to the claimant. In a pedestrian accident case, a driver is required to exercise due care to others on the road. As such, liability is often clear in motor vehicle collisions caused by DUI. The driver under the influence of alcohol or drugs violated their duty of care owed to the claimant and caused a crash resulting in serious injury and damages.
