Multiple Vehicles Linked to Pedestrian Fatality on Forty Mile Road

A man walking on Forty Mile Road was struck by multiple vehicles and died. The pedestrian fatality happened just south of Rosser Road on December 3 shortly after 8:00 in the evening. According to the California Highway Patrol (CHP), the pedestrian was heading north in the number two or right lane of Forty Mile Road. The CHP said the deceased has not been identified at this time and urged anyone who may know the identity of the pedestrian to get in touch with the Yuba County Sheriff’s Office at (530) 749-7777.

Additional Details of the Pedestrian Fatality

According to a representative of the CHP, the fatal accident occurred on a stretch of road that is not well lit with an absence of street lights. They also said the area was bathed in a dense fog at the time of the pedestrian fatality making it hard to see ahead beyond 50 to 100 feet.

Pedestrian Struck Multiple Times

The first vehicle to strike the man was identified as a Toyota pickup, which inflicted major injuries. After this, a Toyota SUV pulled over and tried to shield the man from harm as traffic sped past. A passing Chevrolet pickup did not realize the Toyota had stopped and rear-ended the SUV, pushing it to strike the man lying in the road. Both vehicles remained at the accident scene, and authorities said there was no indication that drugs or alcohol were involved.

Losing a Loved One in a Pedestrian Fatality

When a loved one dies in an auto crash, the family experiences not just grief but also feelings of anger and helplessness. For many families, the loss of a family member can lead to financial difficulties and grief, especially if they provided support both monetarily and emotionally. To resolve the financial issues they face, some families turn to a wrongful death lawsuit

While in no way does a lawsuit for wrongful death relieve the grief a family is experiencing, it does allow them to obtain a sense of justice as the negligent party is taken to task. Although a wrongful death lawsuit is a civil action, it can be lodged against someone who is prosecuted for a criminal offense in reference to the accident. This often happens when a drunk driver causes a fatality.

How a Wrongful Death Lawsuit helps the Family

A wrongful death lawsuit can help the family recover the following monetary damages:

  • Funeral and burial expenses
  • Lost wages the deceased was earning as well as wages they would have been able to earn until reaching retirement
  • The loss of perks associated with their job as well as the benefits they would receive
  • The cost of hiring someone to do household tasks normally done by the decedent
  • The love and loss of consortium a spouse experiences
  • Inheritance the family would receive
  • The emotional support, comfort, and guidance the decedent would provide to members of the family

Filing a Wrongful Death Lawsuit in a Pedestrian Fatality

The following family members are able to file a wrongful death lawsuit:

  • The spouse of the decedent
  • The natural and adopted children of the deceased
  • The stepchildren of the deceased
  • The parents of the decedent
  • The decedent’s siblings

Liability in a Pedestrian Accident

At AutoAccident.com, we dispatch our investigators to the scene of the accident. They use various techniques to determine how and why the crash occurred. For instance, we use accident reconstruction techniques to determine liability and obtain surveillance camera footage to provide visual evidence. The investigators also interview witnesses and review CHP reports for mistakes. Once the evidence is correlated, it is released to our legal team who use it to build a strong case against the at-fault party.
