Two Injured in SR-49 Crash Involving CHP Unit

The California Highway Patrol (CHP) reported that two parties were injured following a crash on SR-49 involving one CHP unit in the San Andreas area. The incident occurred on Thursday, August 19, 2021, on State Route 49, just south of San Andreas.

Details on the SR-49 Crash Involving CHP Unit That Left Two Injured

According to CHP traffic investigators, an officer was responding to a call of a disabled vehicle that was blocking the roadway on Ponderosa Way and SR-4 in Angels Camp. A CHP spokesperson indicated that the CHP unit was not using its lights and sirens nor traveling at a high rate of speed while responding to the traffic hazard report.

A 17-year-old San Andreas girl was driving a 2017 Hyundai Elantra on Magers Way, approaching State Route 49. While attempting to enter SR-49, her vehicle was struck by a CHP unit, a 2020 Chevrolet Tahoe. The impact of the collision propelled the patrol vehicle off the highway and collided with a fence.

Both parties suffered injuries described as minor in the traffic collision, officials said. The Hyundai driver was released to the care of a close relative while the CHP traffic officer was taken to an area hospital as a precaution. The officer has since been released. Additional information on the car accident was not immediately available.

What You Should Know About Car Accidents and Government Vehicles

Motor vehicle accidents involving cars owned and operated by the government are not uncommon in California. Whether that be a motor vehicle owned by the city, county, or state government, the agency that employed the driver who caused the crash may be held liable for the incident.

Dealing with a public agency is different than being involved in a traffic collision with a driver who used a vehicle for personal use because of the strict filing criteria and deadlines that apply to government vehicle accident cases. Once a notice of claim has been submitted within the statute of limitations, the government entity will go over the facts and circumstances of the claim and determine whether to settle or send a rejection letter.

Speaking with an experienced Angels Camp personal injury attorney may help you in understanding the requirements that must be met in your claim and ensure you meet all applicable deadlines. Failing to file within the statute of limitations may waive your right to seek financial recovery. If you are unsure of what to look for in the best attorney in Calaveras County, watch this video.

Importance of Working with an Attorney After an Accident

The right to seek financial compensation for injuries and damages from a government vehicle accident may be limited by California. Because of this, it is essential to conduct an independent investigation of the facts and circumstances of each case. Conversely, a shorter statute of limitations may apply under the California Government Code Section 911.2. Under this section, a claimant has six months or 180 days from the time of the incident to bring a notice of claim with the appropriate public agency.
