Can You Get Compensation for a Modesto Hit and Run Accident?

With a wide array of emotional, physical, and financial hardships placed on injured people after a hit and run, it is essential to know that there may be help available. A personal injury claim allows an injured person to recover compensation from the driver responsible for the accident. While the circumstances of each case may differ, common types of economic and noneconomic damages may be claimed. These include past and future medical expenses, lost wages, loss of earning capacity, property damage (e.g., glasses or clothing damaged in a bicycle accident), and pain and suffering. To recover compensation, injured parties should be aware of what options are available to them.

Does Insurance Cover Hit and Runs in California?

Suffering injuries after a hit and run accident may be stressful. You may be wondering how you will be compensated for your mounting medical expenses and the time you missed at work to recover from your injuries. However, you may have some potential options for recovery. If the negligent driver is located by police, you may be able to file a claim against their insurance company. This is possible so long as the motorist had a valid insurance policy at the time of the incident. If the at-fault party has no insurance, you may be able to bring a claim against your own auto insurance policy if you have uninsured/underinsured motorist protection. The uninsured motorist portion of the plan may compensate you for your losses, even if the driver is not found or has no insurance. Medical payments coverage, or med-pay, may also cover your medical bills as they incur.

How Long Do You Have to File for Personal Injury?

A statute of limitations is the amount of time permitted to file a lawsuit in a personal injury case. Under the California Code of Civil Procedure Section 335.1, a claim must be filed within two years from the date of an accident. If the deadline is not met, the injured person may lose the right to recover compensation for their medical bills, lost wages, and pain and suffering.
