A preliminary release revealed that the initial incident was a rear-end collision involving a pickup truck and a Honda. The Honda reportedly became disabled in the middle lane of northbound Highway 99. As a tow truck driver was removing the Honda from the roadway, a motorcycle rider approached, lost control of their bike, and collided with the tow truck and the Honda.

The Honda driver is suspected of DUI, according to CHP traffic officers. Can You Seek Compensation for Injuries and Losses from a Motorcycle Wreck?

A motor vehicle collision may be a traumatic and life-changing event, especially if a motorcyclist is involved. Motorcycles do not offer the same level of protection as motor vehicles do. This means that bikers are more vulnerable to serious injuries or even death when they are involved in a crash. Common motorcycle injuries include TBIs, spinal cord injuries, road rash, amputations, internal trauma, and broken bones. Some of the common reasons for vehicle versus motorcycle collisions include unsafe lane changes, DUI, not checking for bikers who are lane splitting, speeding, and more.

When a motorcyclist is injured in a wreck through no fault of their own, they may be eligible for financial compensation. Eligible claimants may be compensated for medical bills, lost earnings, and other losses in connection with the incident. Keep in mind that injured parties must seek immediate medical treatment following a crash. There must be medical documentation establishing that reported injuries were from the incident and not from another cause. Prompt medical care and following orders from treating physicians can eliminate the uncertainty and potential disputes from the insurance company.

An independent investigation into a car versus motorcycle collision is necessary to properly establish causation and the losses incurred. A successful claim for damages requires clear and compelling evidence demonstrating driver negligence. Evidence may include police reports, eyewitness accounts, medical records and summaries for crash-related injuries, video surveillance footage, expert witness testimony like an accident reconstruction expert, and more. An experienced attorney can assist by gathering and preserving evidence immediately before it is altered or destroyed.

Is There a Time Limit for Personal Injury Cases?

Personal injury cases are subject to strict deadlines. These are known as the statute of limitations. Per CCP 335.1, claimants have a maximum of two years for filing. A case that is not filed within the time limit runs the risk of being dismissed by the court. This ultimately results in losing the right to seek compensation.
