Things to Know About Wrongful Death Cases

Whether or not surviving family members have a case for wrongful death will depend on the facts and circumstances surrounding the incident that claimed a loved one’s life. There must be clear and compelling evidence demonstrating that the other side owed a duty of care to the deceased and that a breach of the duty of care occurred. From there, causation and damages must be established. Moreover, California law is specific on who can file for wrongful death. Per CCP 335.1, the surviving spouse, domestic partner, or child of the deceased generally has priority for filing.

Eligible survivors may seek reimbursement for intangible harm and financial losses. Damages that are available in a wrongful death case in California may include costs of funeral services, loss of household services, loss of companionship, mental anguish, medical bills associated with the treatment of final injuries (recoverable through a survival action), loss of financial support, and other relevant losses. Punitive damages may be available in a fatal accident case depending on if the at-fault party’s conduct was egregious, like excessive speeding or drunk driving.

A compassionate and skilled California wrongful death lawyer will listen to a family’s story, work with them to determine if they have a wrongful death claim, and discuss their options for financial recovery moving forward.
