What Surviving Family Members Should Know About Wrongful Death Truck Accident Cases

The sudden loss of a family member is challenging regardless of the circumstances that are involved. However, when a close relative suffers fatal injuries in a tractor-trailer collision that was caused by a negligent truck driver or trucking company, it may compound the grieving process with frustration and anger. If a family has experienced this, they may have grounds for a wrongful death claim against the at-fault party. These cases serve the purpose of holding negligent parties and entities financially accountable for their actions and making survivors whole again through compensatory damages. For a big rig crash, a claim is usually filed against the insurer that represents the trucker or trucking company.

There are two types of damages that surviving family members may seek in a wrongful death action. These include economic damages and non-economic damages. The purpose of economic damages is to compensate survivors for financial losses they have experienced from the unexpected loss of a loved one. The other type considers the intangible harm endured by close relatives. California law is specific on who is eligible to file a wrongful death claim. Those with priority for filing include children, domestic partners, and spouses. Other family members who were dependent on the deceased for financial support may be eligible for filing if the other mentioned relatives do not exist.

It is essential to have legal representation after the loss of a loved one in a commercial truck accident. That is because insurance companies will act quickly to dispute liability for the incident as a way of protecting their bottom line.
