Who is Responsible for a Truck Accident?

Serious injuries often result from commercial truck accidents, particularly for those riding in passenger vehicles. In such situations, a personal injury claim may be brought against the at-fault party or entity for economic and non-economic damages like medical bills, wage loss, pain and suffering, and other accident-related losses. As with any case, liability must be proven through clear and compelling evidence. Some of the parties that may be held financially accountable for a big rig crash resulting in injuries and losses may include:

  • Truck Driver: An independent investigation into a semi-truck accident generally starts with the driver who was operating the big rig at the time of the incident. Reasons that a trucker may have caused a crash include driving under the influence (DUI), fatigue from not following the Hours of Service (HOS) regulations, texting and driving, and more.
  • Truck Company: As with any company, a trucking company may be held accountable for the actions of an employee in specific circumstances. They also have legal obligations to properly screen, train, and monitor truck drivers in addition to following safety protocol set out by state and federal laws. Appropriate policies must also be in place for truck maintenance. A trucking company may be held liable for an 18-wheeler wreck for the failure to follow any of these legal duties.

Since there are other parties that may be held liable for a truck accident, it is essential to have your injury case evaluated by an experienced attorney in your area. For information on how to find the right lawyer to represent you, watch this video.

What is the Filing Deadline for a Personal Injury Case in California?

In California, there are strict rules on the amount of time you must file a lawsuit in civil court. This is known as the statute of limitations. Under the California Code of Civil Procedure Section 335.1, a claimant has two years from the date of the crash to file a lawsuit. Failure to follow this may result in the court’s dismissal of the case. If you or a loved one has been injured in a big rig crash, do not wait to get assistance.
