Minor Killed After Being Served Alcoholic Beverage

A tragic early morning traffic fatality closed major streets in Folsom recently when the driver lost control of her vehicle. According to police, the car overturned before it hit a tree. A witness to the accident who called the police said that he was unable to reach the vehicle.

Details of the Accident

20-year-old Yasmina Azamatova, an Antelope resident, went to a Folsom restaurant prior to the accident and was served alcohol. At about 2:00 in the morning, she got into her car and drove up to East Bidwell, where her vehicle left the road near Oak Avenue Parkway, striking the median and rolling into the nearby tree. Azamatova’s vehicle quickly caught on fire, and she died in the crash. According to reports by the Folsom Police Department, speed is suspected as a precipitating cause of the accident. Authorities are using a drone to determine why the accident happened by reconstructing the path Azamatova’s vehicle took. The drone will be able to determine the vehicle’s speed. A GoFundMe page has been created on behalf of Yasmina Azamatova and her family to help cover her funeral expenses.

Serving Alcohol to a Minor

Two people were arrested by Alcohol Beverage Control authorities recently for selling alcohol to a minor who became a traffic fatality after leaving the establishment. Jae Jo, a Sacramento resident, age 28, and Tomas Green, a Folsom resident, age 47, were placed under arrest. In addition to charging them with selling to a minor, Green was also charged with selling alcohol to another patron who was obviously drunk. The incidents occurred at a restaurant on Palladio Parkway, which is located in Folsom. Authorities with the Folsom Police Department and California Highway Patrol (CHP) helped ABC authorities in the investigation, which led to the arrests of the two restaurant employees. Disciplinary action is being sought by the ABC against the restaurant for violating Section 25658(c) and the for continuing to serve someone already under the influence.

Losing a Loved One in a Traffic Fatality

Unexpectedly losing a loved one in a traffic fatality can be overwhelming to those family members left behind. While dealing with a family member’s death is never easy, the effects are even more pronounced when the person dies suddenly. Beyond the grief, family members may show signs of shock. This includes withdrawing from the situation and refusing to believe the individual is gone. They may exhibit physical signs of shock, such as anxiety and confusion. It is important to take this into consideration when trying to help. Remember that they need to grieve in their own way. Let them take the lead and find ways to help them, such as shopping, helping with other chores, and offering transportation to and from appointments.

Dram Shop Laws in California

Dram shop laws make it illegal to serve alcoholic beverages to a minor in California. In most cases, the law does protect bartenders, restaurants, and bars from liability. However, if there is sufficient reason to believe the minor was intoxicated at the time they were served, the establishment or the bartender can be held liable for the person’s wrongful death. Talking to an experienced lawyer about this is helpful.

How a Personal Injury Lawyer Can Help

It is critical to evaluate every aspect of a wrongful death accident since the deceased can no longer explain what happened. Sometimes, the reason for a traffic fatality seems obvious, but that may change. Our investigators are experienced in deciphering complicated cases. We dispatch them to the accident site to look for evidence as to why the crash happened.

If the traffic fatality involves a single vehicle running off the road, our investigative team uses accident reconstruction techniques to digitally evaluate the accident and obtain traffic surveillance photos. They also review police reports for mistakes. The investigators look for road marks that might explain why a vehicle did not stop or why it veered off the road. In cases like the one described above, we look into the liability of the establishment, or an employee who provided alcohol illegally to a minor. Once all the information pertinent to the traffic fatality is amassed, it is released to our lawyers who use it to build a strong wrongful death case.
