Franklin Boulevard Site of Car Versus Cement Mixer Traffic Accident

On August 14, a traffic accident occurred along the 6000 block of Franklin Boulevard when a sedan collided with a cement mixer shortly before 9:00 in the morning. The cement mixer was lying on its side, which was a traffic hazard, according to the California Highway Patrol (CHP). The southbound lanes of Franklin Boulevard were blocked while the cement mixer was removed. It is unknown if injuries were reported.

Roadway Debris as the Cause of a Traffic Accident

It isn’t unusual for a motorist to encounter debris along California roads. Debris may include tree limbs, furniture or even a car or boat that slips from its carrier. For the unwary driver, it can lead to a collision. To avoid the object in the roadway, the driver must stop suddenly or swerve out of the way. This could cause a rear-end collision or involve a traffic accident with a vehicle in the next lane. Dangers of road debris are not only to those in passenger vehicles. They can cause severe injuries to bicyclists, motorcyclists or pedestrians.

Is It Illegal to Drop Debris on the Roadway?

Under California Vehicle Code 23113, anyone who drops debris on the roadway carries the responsibility of removing it. If they do not do so, the government entity in charge must and can recover the cost from the offending party. When someone is injured, they may place a claim against the offending driver with the help of an experienced lawyer.

Can a Person Injured by Road Debris Be Compensated?

A person who drops something in the roadway that can be hazardous to others is responsible for retrieving it. If that debris injures a motorist or others, they may file a claim against the at-fault party for compensation. Personal injury damages include the medical expenses, pain and suffering and any wages lost because the injured person could not work.

Over my years as a personal injury lawyer, I’ve helped many people obtain the compensation they deserve. It is important to me because someone who has been injured by another’s negligent actions should not have to face financial loss from it in addition. As always, your first consultation is free, and you have no charges from my law firm until we have won your case.

Crashes Caused by Road Debris Are Avoidable

According to the American Automobile Association, roadway debris, including shredded tires and furniture, led to 200,000 collisions and around 500 fatalities during the three-year period of their study. Injuries from collisions with road debris totaled about 39,000, and none of them had to occur. One of the major problems is that when a car or truck strikes a piece of debris, it can lead to a multiple-vehicle crash.

Highways are more dangerous when it comes to accidents with road debris. Because vehicles are traveling at a much higher rate of speed than on city streets, it increases the risk of serious injuries as well as involving other cars and trucks.

Investigating the Accident

We send our team of investigators to the traffic accident location to uncover the evidence to support a client’s compensation claim. They look for mistakes in the police report and interview witnesses. They also perform accident reconstruction and search for cameras in the area that might have captured the collision on video. Our lawyers use this information to build a strong court case or to conduct negotiations with the insurance company.
