Tracy Man Killed in Rollover Crash on Interstate 5

Officials reported that a Tracy man was killed in a recent rollover crash on Interstate 5 just west of the Mendota area in Fresno County. The single-vehicle accident occurred shortly after 8:00 a.m. on southbound I-5 near California Avenue, according to a news release by the California Highway Patrol (CHP).

Details on the Interstate 5 Rollover Crash That Claimed the Life of a Tracy Man

A preliminary report by CHP traffic officers revealed that a man was driving a 2002 Ford in the No.1 lane of southbound Interstate 5. Authorities reported that the man reportedly veered to the left to avoid a car stopped ahead, traveled off the roadway and down the shoulder. The Ford allegedly overturned onto a dirt embankment and came to a rest on its roof.

Sadly, the Ford driver succumbed to his injuries at the crash site. The Fresno County Coroner’s Office has recently identified the decedent as 60-year-old David Coubrough of Tracy.

Fatal Single-Vehicle Crashes and Wrongful Death Cases

Losing a close relative suddenly is heartbreaking and devastating. However, if it was the result of someone else’s fault, survivors should know that they may have rights and options for recovery. Through a wrongful death claim, surviving family members may seek compensation for economic and non-economic damages. Since the value of the claim will depend on the facts and circumstances of the case, it is essential to speak with an attorney regarding the case. This is especially true in the case of a single-vehicle crash, as other parties may be potentially liable for the incident.

A single-car accident resulting in injury or death may occur because of a road defect. These are often the result of poor roadway design or maintenance. When this happens, the injured party or family of the decedent may bring a notice of claim against the government entity responsible for the design and upkeep of the public road. Some of the types of defects that result in fatal roadway crashes may include potholes, uneven lanes, overgrown vegetation, lack of warning signage, and more. Keep in mind that government entity claims are subject to a shorter filing deadline, as outlined in the California Government Code Section 911.2. Survivors have six months or 180 days to bring notice of claims for road defects.

A fatal single-vehicle accident may also be caused by a vehicle defect. Some of these may include defects in the design or manufacturing of the vehicle. In most cases, it may not be immediately apparent that a traffic collision involved faulty car parts or equipment without an independent investigation. For this reason, it is crucial for any family who has lost a loved one in a rollover collision to speak with an experienced Tracy wrongful death attorney. A lawyer with years of experience handling these cases may look into whether a car involved in a fatal rollover crash failed to meet Federal Motor Vehicle Safety Standard 216 in regard to roof crush resistance. If this is the case, the attorney may bring an auto products liability claim against the manufacturer for damages incurred.
