Tracy Man Killed in Motorcycle Accident in Lamont

The California Highway Patrol (CHP) has identified a man killed in a recent hit-and-run motorcycle accident near Lamont in Kern County as Christian Javier Reynoso, 24, of Tracy. Officials have not yet located the driver responsible for the hit-and-run accident. The family of Mr. Reynoso has set up a GoFundMe page to help cover final resting costs.

Details on the Lamont Motorcycle Accident That Claimed the Life of a Tracy Man

According to a preliminary report by CHP traffic officers, the motor vehicle accident was reported shortly after 8:40 p.m. at Bear Mountain Boulevard and Weedpatch Highway (State Route 184) near Lamont. Authorities said a dark-colored SUV was involved in a crash with a rider of a 2020 Suzuki motorcycle that was headed southbound on SR-184.

The impact of the collision reportedly propelled the man, Mr. Reynoso, off the motorcycle. Sadly, he succumbed to his injuries at the scene. Officials indicated that the SUV driver left the scene and was last reported to have been traveling north on Highway 184 following the incident. Anyone with details on the fatal motorcycle accident is encouraged to contact the CHP Bakersfield area office.

Does Insurance Cover Hit and Run Accidents?

A hit-and-run accident is generally in reference to a situation where a motorist crashes into another vehicle, pedestrian, or cyclist and leaves the scene. Several reasons may influence why a driver may decide to flee the scene of a traffic collision, including driving under the influence (DUI) of alcohol or drugs, driving on a suspended license, and more. Anyone who has been injured or lost a loved one through this type of traffic collision should retain legal counsel right away. An attorney can get to work quickly to examine the facts and circumstances of the case and advocate on behalf of those they represent. An injury lawyer will also work with difficult insurance companies to reach a favorable resolution, whether that be in insurance negotiations or in the courtroom.

In California, any person who has been injured or lost a loved one in a hit-and-run collision may seek recourse through their uninsured and underinsured motorist coverage (UM and UIM). The UM coverage will come into play to cover damages resulting from the incident, up to the limits of the policy. The contractual language of some insurance policies may require the claimant to prove that another vehicle came into contact with them, whether that be while driving, riding as a passenger, walking as a pedestrian, or cycling. Once this has been met, economic and non-economic damages may be sought to cover financial and intangible losses incurred. In wrongful death claims, this may include lost future financial support, funeral costs, end-of-life medical care, loss of companionship, and more.

Punitive damages may also be available in some wrongful death cases where it has been found that the at-fault party engaged in egregious conduct leading up to the fatal incident. This type of damage is not intended to be awarded to surviving family members to restore them financially following the loss of a loved one. Instead, they are designed to punish the at-fault party for their actions and discourage similar behavior in the future. It may be challenging to obtain punitive damages in wrongful death cases, particularly those involving hit-and-run drivers. The process would generally involve an experienced accident attorney proving that there was gross negligence through compelling evidence. Importance of Speaking with an Attorney on a Wrongful Death Claim

One of the most crucial reasons for surviving family members to speak with a Tracy wrongful death lawyer is to acquire assistance in preserving the evidence necessary in proving the case.
