Three Injured in Car Crash on Highway 41

Three parties were injured in a recent car crash on Highway 41 in Madera County. The California Highway Patrol described the incident as a head-on collision involving two vehicles that took place on SR-41 in the vicinity of Road 406 shortly before 6:00 p.m.

Details on the Car Crash on Highway 41 That Left Three Injured

Officials said one of the two involved vehicles allegedly veered over the double yellow lines into the oncoming traffic lane and collided head-on with the other car. One vehicle reportedly spun out and came to a rest after striking a rock embankment located off SR-41. This caused the driver of this vehicle to be pinned inside, and they required emergency extrication by fire crews at the scene.

The driver was transported via air ambulance to an area hospital for treatment of serious injuries. The other vehicle, a pickup truck, came to a rest on its wheels. CHP traffic officers indicated that the two occupants of the pickup truck sustained injuries described as minor. Additional information on the head-on collision on State Route 41 in Madera County was not immediately available.

What You Should Know About Head-On Collisions and Personal Injury Claims

A head-on collision is likely to result in some of the most catastrophic injuries on the spectrum because of the physics involved in this type of accident. When two cars are approaching from opposite directions and collide with one another, the forces involved are combined, and the resulting injuries are reflective of that impact. Given that the impact is likely to propel vehicle occupants forward, they may suffer traumatic brain injuries, spinal cord injuries, lower extremity injuries, chest trauma, bone fractures, and more. While there is a wide array of possible causes of head-on collisions, some of them are likely attributed to distracted driving through cell phone use and other distractions, failing to follow traffic signals and signs, and unsafe lane changes to overtake slower moving traffic. The latter is likely to occur in rural areas such as those in Madera County and surrounding areas.

Regardless of the specific cause of the incident, most of these cases are attributed to driver negligence, whether that be on the part of another driver or entity. When a motor vehicle collision is found to have occurred because of driver negligence, injured parties may seek financial compensation for their losses through the form of a personal injury claim. The purpose of these cases is to make injured parties whole again through economic and non-economic damages. These damages consider the financial and intangible losses that have occurred from accident-related injuries and are intended to compensate the claimant in a way that places them in their position before the incident.

A bodily injury claim is generally brought against the insurance company representing the other side. However, there are some unique situations where an injured party will have to turn to their insurer for uninsured and underinsured motorist coverage. This is likely to occur when it has been determined that the at-fault party lacks liability coverage or carries insufficient insurance to cover losses that have resulted from the car accident. While we would expect the insurance company to make things right with an injured party by providing them with the fair compensation that they need to put the traumatic incident behind them, that is not always the case. It is not uncommon for an insurer to dispute liability for a head-on collision through various defense tactics. That is why it is a good idea to work with an experienced Madera car accident lawyer who can work hard to protect your best interests and secure a successful outcome in your case.
