Teenager Killed After Rollover Crash in Los Banos

A teenager was killed, and three others were injured after a rollover crash in the Los Banos area on the evening of Tuesday, September 29, 2020. The car accident occurred shortly before 5:00 p.m. on Ingomar Grade Road just north of Sylvester Road. A 2001 Chevrolet was headed southbound on Ingomar Grade Road when the driver of the vehicle, a 13-year-old boy, reportedly lost control of the car while approaching a curve in the road. The Chevrolet allegedly veered off the roadway and overturned several times.

According to the California Highway Patrol (CHP), the driver and two of three passengers, a 14-year-old and a 15-year-old boy, all suffered minor injuries. Sadly, the third passenger, a 14-year-old boy, was killed in the rollover collision. The cause of the fatal crash is under investigation by the CHP, and no further details about the incident have yet been released.

Loss of a Loved One

A rollover accident may be life-changing to those who survive and devastating to the family of those that do not. This is especially true in the case of a crash caused by the negligence or carelessness of someone else. Surviving family members may be stressed about how they are going to pay for their loved one’s final resting expenses. If you find yourself in this situation, this is one of the many things a Los Banos wrongful death attorney can help you seek financial compensation for.

What Can Be Recovered in a Wrongful Death Case for a Los Banos Rollover Crash?

The value of a wrongful death lawsuit depends upon a wide array of factors. This includes the age, education, life expectancy, and earning potential of the decedent as well as the emotional and financial damages related to the loss. The type and amount of insurance coverage available to compensate surviving family members for their loss also play a factor in a wrongful death accident case.

In the case of a rollover accident, other parties may also be held financially accountable for a loved one’s wrongful death, such as the manufacturer of the vehicle, which is why it is critical to preserve your wrecked vehicle after a rollover. If it has been proven that catastrophic or fatal injuries resulted from a roof of a vehicle failing to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance, the family may seek monetary damages from the automaker for the fatal crash. These come in two types, economic and non-economic, including:

  • Costs related to funeral and burial services for a lost loved one
  • Expenses associated with the end of life medical treatment received by the decedent after the rollover accident before they succumbed to their injuries
  • Loss of a loved one’s care, protection, and companionship
  • Lost future financial support and services

Who is Eligible for Wrongful Death Damages in California?

If you have lost someone you love, you may be wondering how you can take immediate action for justice on behalf of your loved one. You can do so by bringing a wrongful death claim against the at-fault party. An experienced Los Banos wrongful death lawyer can help guide you and your family through the claims process and determine whether you are eligible to bring a case on behalf of your family member. You may be able to file a wrongful death action if you are the surviving spouse, domestic partner, or children of the deceased. If you are not any of these parties but a surviving parent, putative spouse, stepchild, or child of the decedent’s putative spouse, you may be eligible to bring a claim. Refer to the California Code of Civil Procedure Section 377.60 for additional details, or watch the video below.
