Suing a Modesto Grocery Store For Food Poisoning

I’m Ed Smith, a Modesto Personal Injury Attorney. Have you become seriously ill from food poisoning? Do you believe that a grocery store or other food retailer may be the source of your foodborne illness? If so, did you know that you might be able to obtain compensation for your injury if there is enough evidence to support your claim?

What Is Foodborne Illness?

Watch the Youtube Video below to learn how the foods we eat can sometimes become contaminated.

Food Poisoning Outbreaks

Food poisoning outbreaks occur all the time, and in some cases, these outbreaks can be linked to certain grocery store chains and bigger food retailers. However, proving the source of your foodborne illness is not always easy, especially because oftentimes there is a delay between consuming contaminated food or drink and any onset of symptoms. Moreover, it can be hard to remember everything you’ve eaten in the days, weeks, or even months prior to becoming ill.

Knowing What Food Product Caused Your Illness

It is usually easier to prove your case if a health department has been able to determine that an outbreak was caused by a particular food product. But in any event, if you are able to pinpoint the source of your foodborne illness, in most cases, rather than having to show that the grocery store or another retailer was negligent in handling or distributing a food product, you just have to prove that the food product you ate was contaminated with a certain pathogen, and that that pathogen made you sick.

Determining The Pathogen

Typically, in order to make a claim in a food poisoning case, you must first determine the pathogen that made you sick. This can be done by consulting a health care provider and usually by undergoing blood, urine, or fecal testing. Testing can determine whether your food poisoning was caused one of the many different pathogens out there including E. coli, salmonella, listeria, shigella, hepatitis A, campylobacter, cyclospora, and clostridium botulinum. Many of these viruses and bacteria can cause severe illnesses that in some cases can result in death.

Is There An Outbreak?

After you have sought medical treatment for your foodborne illness, it is important to contact a local health department and let them know that you have been poisoned by food. The health department will likely ask you to remember where and what you ate prior to becoming ill. In this instance, you will have to try your best to remember what you ate in the days or even weeks before your symptoms began. If it is determined that other people became ill after eating a food product from a particular grocery store or other food retailer, officials from the health department will probably inspect the store and take samples to see if there is any evidence of a specific source of pathogens.

Hiring A Modesto Food Poisoning Attorney

If your foodborne illness has been linked to a specific grocery store or another food retailer, and your symptoms have worsened, or the illness has developed serious complications or resulted in serious injury, it may be time to consult with an experienced personal injury lawyer. An experienced lawyer will typically conduct their own investigation into the illness, determine whether a particular grocery store has a poor track record when it comes to food safety, and can help increase your chances of a successful outcome in your case.

In the meantime, it is important to document the injuries that you have sustained as a result of your foodborne illness. Be sure to take photos and videos that can illustrate how your illness has adversely affected you, retain any and all medical records and medical bills, and keep track of any other costs and expenses that might be associated with your illness.
