Stockton Truck Accident Fatality

A Stockton truck accident fatality occurred during the early morning hours of January 8 along northbound Highway 99 near Arch Road. A disabled Peterbilt silage truck was parked along the right shoulder of the highway, partially blocking the right lane. An oncoming 2013 Peterbilt big rig was approaching from behind and was being followed by a 2017 International tractor-trailer. The Peterbilt driver reduced his speed and moved to the left to avoid a collision with the disabled truck in the roadway. However, the International driver was unable to stop in time and hit the right rear of the Peterbilt’s trailer and struck the disabled truck. Sadly, the International driver was pronounced deceased at the scene by emergency personnel. Officials have identified the victim as 36-year-old Pedro Avila of Modesto.

We would like to offer our sincere condolences to the family and friends of Mr. Avila in their time of loss and sorrow.

Loved One Forever Remembered

Pedro “Pete” Avila was a beloved member of his family. He was a dedicated father to four children and a loving husband to his wife. He will be remembered for his kind and loving soul. A GoFundMe page has been established to help support his family during this difficult time.

Common Causes of Truck Accidents

Truck accidents are often preventable and caused by the negligence of truckers and trucking companies. Sudden stops or unsafe lane changes, equipment failure, intoxicated or fatigued drivers, lack of truck maintenance and failure to adhere to traffic safety regulations are among the most common causes of these types of collisions.

Recovering Damages in a Trucking Accident

After a truck crash, injured parties can face many emotional, physical and financial challenges. For instance, paying for medical treatment can add financial stress and lost wages from time away from work can be an overwhelming burden. Compensation may be available for those injured in truck accidents caused by the negligence of another party or entity. This can be used to help pay for rehabilitation costs, medical expenses, lost wages, loss of earning capacity, emotional distress, loss of consortium, disfigurement, disability, and loss of enjoyment of life. Conversely, it may also be used to help cover damages incurred from a loved one’s wrongful death.

Wrongful Death in a Truck Accident

Because of the sheer size and weight of a large truck, they can cause serious injury or even death. When someone loses their life in a truck accident, the surviving family members may be able to pursue a wrongful death claim against those responsible for the crash. These types of cases are intended to compensate a grieving family for losses they have experienced as a result of their loved one’s unexpected death. Often, injured parties or families of decedents do not know who to turn to for assistance. An experienced wrongful death attorney in Stockton can help in difficult times such as these by recovering fair compensation for resultant damages.
