Some Common Causes of Auto versus Pedestrian Accidents

Under California law, a motor vehicle must yield to any pedestrian who is in a crosswalk. The driver must also yield to a pedestrian traversing through an intersection that is a non-marked walkway. See California Vehicle Code Section 21950(a). This means that most, if not all, traffic collisions between a car and a pedestrian in these types of locations are the result of driver negligence. Many other pedestrian accidents are the motorist’s fault, in whole or in part. Retaining a skilled and dedicated Stockton Pedestrian Accident Attorney right away is crucial to pursuing all your available legal remedies.

There are many types of pedestrian versus car accidents, but some of the more common causes are as follows:

  • Distracted driving – This broad term includes texting, talking on a cell phone, eating or drinking, applying makeup or attending to one’s personal hygiene, arguing with a passenger in the vehicle, or engaging in any activity that takes the driver’s focus off the roadway;
  • Driving while sleepy or fatigued;
  • Failing to yield;
  • Driving under the influence of alcohol or drugs;
  • Failure to yield;
  • Failure to stop at a stop light or sign;
  • Excessive Speed;
  • Failing to use a signal when making a turn and
  • Driving aggressively.
