What Types of Damages Can Be Recovered in a Wrongful Death Case?

A wrongful death action serves to hold an at-fault party liable for the harm they have caused to surviving family members. When it comes to the types of recoverable losses in a wrongful death claim, a wide array of components must be considered. This includes the decedent’s age, education, occupation, health, life expectancy, and a myriad of other factors. In these cases, the following economic and non-economic damages are generally recoverable:

  • Emotional and mental anguish
  • Costs of funeral and burial services
  • Loss of the decedent’s care, companionship, and protection for the family
  • Loss of benefits, such as health insurance coverage, pension, and retirement
  • Lost earnings that would have been contributed to the household if not for the fatal incident
  • Expenses of end-of-life medical care for the deceased (costs of medical treatment are generally recoverable in a survival action)

While financial compensation from a wrongful death claim cannot bring a precious loved one back, it may help alleviate the financial hardship that may accompany the sudden loss of a family member. It may also work to provide a more secure future for survivors. Learn how our legal team can help your family with your claim by watching the video below.
