Stockton Man Killed in Bicycle Accident

A Stockton man was killed in a recent bicycle accident along McDougald Boulevard and Carolyn Weston Boulevard near Weston Ranch. The man was riding his bicycle near the intersection when he was hit by an oncoming vehicle shortly before 8:00 in the morning. The driver of the car stopped at the scene and cooperated with investigators, according to the Stockton Police Department. The injured cyclist was transported to a local hospital for treatment of unknown injuries. Sadly, he was pronounced deceased during hospitalization. The San Joaquin County Coroner’s Office has identified the decedent as Martin Garcia, a 35-year-old man from Stockton. I would like to send my healing thoughts and prayers to the friends and family of Mr. Garcia in their time of loss and sorrow.

Accident Investigation

The cause of the bike accident is not yet known due to an ongoing investigation. A traffic collision report for a cycling crash usually takes one to two weeks to be processed. However, this time limit may be extended when a fatality is involved. Moreover, a GoFundMe page has been established by the family of Martin Garcia to help cover his funeral expenses.

What are the Most Common Causes of Bicycle Accidents?

Bicycle accidents are often caused by driver error. Common causes of these accidents include:

  • Driving too fast for road or weather conditions
  • Driving under the influence of alcohol or drugs
  • Failing to yield to cyclists when making left-hand turns
  • Opening a car door in the path of a cyclist
  • Reckless driving such as violating the directions of traffic lights or stop signs
  • Switching lanes without providing a sufficient signal for others

Bicycle Accidents and Wrongful Death

When a cyclist suffers fatal injuries in a collision with a motor vehicle, his or her family often faces daunting emotional and financial damages. When this happens, the surviving family of the decedent may file a wrongful death claim against the party responsible for the incident for losses incurred. This includes reimbursement for the cost of medical care received by the decedent before his or her passing, funeral and burial expenses, loss of consortium for the surviving spouse or domestic partner, loss of services performed by the deceased for the household, and more. For information on who may be eligible to file for wrongful death, watch the below video.
