Stockton Man Died from Injuries in Crash

A man who was hurt in a hit-and-run pedestrian crash in Stockton on January 22, 2023, has recently died from his injuries. Family members said 60-year-old Stockton resident Jose Lopez was hospitalized in critical condition for approximately three months before succumbing to his injuries.

Driver at Large for Hit-and-Run Crash in Stockton

The motorist who caused the hit-and-run accident on January 22, 2023, at the intersection of Dr. Martin Luther King Jr. Boulevard and Sutter Street in Stockton still remains at large, according to officials. The motorist who struck the Stockton father of two and grandfather of three allegedly fled the site and left him alone in the poorly lit street until a Stockton PD officer drove by and stopped, family members said.

Sadly, Mr. Lopez succumbed to his injuries three months following the hit-and-run pedestrian accident. A GoFundMe page has been set up for the Lopez family to assist them with medical and funeral costs. Family members said Mr. Lopez was a talkative, caring, and loving man and find it unfathomable that the motorist responsible for the pedestrian crash left the scene.

Individuals with details on the hit-and-run accident case are encouraged to contact investigators from Stockton PD at (209) 937-8377. Eyewitnesses are urged to come forward and provide information that may assist in the arrest of the driver responsible for the fatal hit-and-run pedestrian crash on Sutter Street near Charter Way in Stockton.

Getting Help From an Attorney on a Hit-and-Run Accident Case

If you have lost a loved one in a hit-and-run pedestrian accident, our legal team at AutoAccident.com can help you and your family learn more about your case and your rights. Obtaining justice and full financial recovery requires immediate legal action. Once the window has closed to file a lawsuit in civil court, the right to seek compensation from the at-fault party may be lost forever. Our legal team dedicates ourselves to each accident case we handle with the integrity, compassion, and care our clients deserve. For your case, you can expect our injury lawyers to:

  • Identify all individuals and entities who may be held liable for a pedestrian accident caused by a hit-and-run driver. An independent investigation by an attorney can reveal that a government entity may be held responsible for the harm that survivors have suffered in addition to the negligent motorist. Grounds for a claim against a public agency must establish that they failed in their duty to design a public roadway for pedestrian safety and maintain that road, including well-lit streets and sufficient pedestrian crossings.
  • Work closely with expert witnesses to establish liability and determine future damages. This includes working with an accident reconstruction expert who can provide their opinion on how the hit-and-run accident occurred based on the facts surrounding the incident and their expertise. Testimony from an accident reconstruction expert is most helpful in cases where there is disputed liability, limited video surveillance footage of the incident, and insufficient evidence.
  • Handle communication and negotiation with insurers for a wrongful death claim. In the event of a hit-and-run accident where the suspect motorist goes unidentified, a lawyer may also help with an uninsured motorist claim through the decedent’s policy or their family member’s plan. The latter is a potential option if the deceased lived with that close relative and was not listed as an excluded member of that insurance policy.
  • If a mutual settlement agreement is not reached within the applicable statute of limitations (generally two years for wrongful death per CCP 335.1 or six months for cases against public agencies per California Government Code Section 911.2), an attorney will file suit in civil court to protect the statute. Failure to do so may result in the case being thrown out by the court and losing the right to seek damages. The lawyer will proceed with litigating the case and preparing it to present in trial if necessary.
