Stockton Accident Fatally Injures Passenger

Stockton Accident Fatally Injures Passenger — Recently, a single-vehicle accident in southeast Stockton claimed the life of a passenger. The accident occurred shortly after 7:30 in the evening along South Airport Way in the vicinity of Ralph Avenue. A Honda CR-V SUV was traveling eastbound when, for unknown reasons, the vehicle began overturning and collided with a short chain link face. The Honda later came to a rest along the front yard of a home along Ralph Avenue facing westbound. Officers responding to the scene found three occupants inside the vehicle, two of which were uninjured in the accident. The third individual, described as a young man, complained of chest pain and was taken to an area hospital for treatment. Sadly, the man’s condition worsened, and he succumbed to his injuries during hospitalization. His identity has been withheld due to pending notification of family members.

Our deepest sympathies are extended to the family and friends of the man who passed away in this tragic accident.

Accidents Involving Only One Vehicle

Driver error is a common cause of single vehicle accidents. Such accidents may be caused by fatigue when a motorist begins dozing off or even falling asleep behind the wheel. Speeding is also responsible for such collisions as drivers often lose control of their vehicle when traveling at high speeds. Moreover, drugged or drunk driving is also attributable to a high number of wrongful death car accidents.

Outside Influences That Can Cause a Single Vehicle Accidents

Not all single vehicle accidents are caused by motorist error. Such accidents may be caused by outside influences such as:

  • Road Rage Incidents and Aggressive Driving: Drivers who do not respect the right-of-way of other motorists or causes a road rage incident can put the lives of others at risk. Some examples of road rage or aggressive driving include slamming on the brakes intentionally and forcing another car off the road.
  • Auto Products Defect: Some collisions can be caused by faulty vehicle equipment. Defects in the accelerator pedals, steering wheels, and brakes can affect a motorist’s ability to control a car safely. When this occurs, the injured party or family of the deceased can claim compensation due to an auto defect.
  • Road Defects: Poor roadway design, insufficient road maintenance, missing signage, and improper markings can result in loss of vehicle control. When a road defect results in traumatic injuries or the death of a loved one, a claim may be filed against the state and/or local agency responsible for roadway design and maintenance. Such claims must be filed within the statute of limitations, which is six months or 180 days from the date of injury or death of a loved one. Contact an attorney for more information.

Passenger Injury Claims

When a passenger is injured in a single vehicle accident, a claim may be filed against the driver. The motorist is responsible for exercising due care when operating a motor vehicle to protect his or her passengers and others on the road. When a driver breaches this duty of care, this can make them liable for subsequent injuries suffered by passengers and resultant damages. These may include medical costs, lost wages, disfigurement, and other related losses. In the case of wrongful death, surviving family members of a deceased passenger may also bring a wrongful death claim against the responsible driver for end-of-life medical care, costs of holding a funeral, and the like.
