Westbound I-80 Fatality Reported in Single-Vehicle Accident

A single-vehicle accident took place in Weimer near Auburn on April 13, killing a Colfax man, age 19. The collision happened along Interstate 80 westbound at the intersection with West Paoli Lane around 9:00 p.m. The preliminary investigation into the accident by the California Highway Patrol (CHP) determined the Hyundai the man was driving suddenly exited the highway, striking several trees and overturning, ending up on its roof.

Investigation Into Cause of Single-Vehicle Accident in Process

The vehicle caught fire, which a passerby put out. The driver was found by emergency personnel to be unresponsive. Although life-saving procedures were performed by emergency personnel in an attempt to save the driver’s life, they were unsuccessful, and he died at the scene. The investigation into the cause of the single-vehicle accident is ongoing.

Single Vehicle Accidents at Intersections

In some cases, a single-vehicle accident at an intersection may not be caused by driver negligence. This could include malfunctioning traffic signals or signs, confusion due to multiple roadways merging together or hazardous conditions such as wet pavement. In this instance, determining who is liable for damages can be difficult. Legal counsel can help you understand the details of the accident and the factors that contributed to the crash. Depending on the circumstances, the grieving family may be able to seek compensation for funeral expenses and other losses associated with the accident by filing a wrongful death claim.

Who Can File a Wrongful Death Claim

In California, the surviving spouse and children of the deceased can file for wrongful death. The estate administrator can also, but only one claim is permitted.

Compensation That Can Be Recovered in a Wrongful Death

Recovery of damages in a wrongful death can vary, depending on the individual case. However, the following is often recoverable:

  • Expenses for the funeral and burial are recoverable.
  • The decedent’s wages until retirement age can be recovered, including their insurance and pension benefits and others.
  • The spouse may recover compensation for the loss of love, affection, and consortium.
  • The family’s children may recover compensation for the loss of their parent and the guidance and nurturing they can no longer provide.
  • Compensation may be sought for work the deceased did around the home on a regular basis, such as mowing the lawn, taking care of the children, and others.
