Personal Injury Claims for Vehicle Versus Pedestrian Collisions

A traffic collision may be a life-changing experience, particularly in those that involve pedestrians. These crashes tend to occur because of inattentive motorists, those who speed, drivers not yielding the right-of-way to pedestrians, poor visibility from weather and road conditions, and driving under the influence. In either of these scenarios, an injured pedestrian may bring a bodily injury claim for the resulting losses. The purpose of a personal injury claim for a pedestrian accident is to make the claimant whole again. This is accomplished by securing compensation for economic and non-economic damages.

In most pedestrian accident claims, there are serious injuries involved that may require extensive treatment. The other side may be held liable for the costs of treatment in addition to the costs of future care. A claimant may seek reimbursement for lost earnings if they were unable to work due to recovering from accident-related injuries. If the claimant is permanently unable to work because of disability from the incident, they may seek compensation for diminished earning potential. Damages for pain and suffering may be sought for the physical pain and emotional anguish caused by pedestrian injuries.

An experienced injury attorney can maximize a client’s case award by exploring all channels of financial recovery in the pedestrian accident. If the incident was the result of a hit-and-run, an injured party can depend on their lawyer to use their resources and work with a private investigator to locate the suspect motorist. In the meantime, the attorney will look to see if there is uninsured motorist coverage available to the injured pedestrian, whether that be through the claimant’s insurance policy or that of a family member they live with.
