Rancho Road Crash With a Train Injures Big Rig Driver

A semi-truck driver reportedly suffered injuries in a crash with a train in Plumas Lake on October 20. The crash was reported around 2:30 p.m. at Rancho and Ostrom roads on the Union Pacific railroad tracks. The reporting person was told about the accident at the lumbar yard and ran to the scene to report the collision.

Crash With a Train Puts Semi Driver in the Hospital

When California Highway Patrol (CHP) officers arrived, they discovered the big rig driver still in their vehicle and the big rig leaking diesel. An ambulance was called for the driver to transport them to a hospital. The railroad tracks in this location were not equipped with crossing arms. The train continued on its trip around 6:15 p.m.

Whether a Railroad Company or Others Are Liable for an Injury Accident

Railroad companies or track owners can be held financially accountable for a crash with a train resulting in injuries. This is when they fail to take appropriate steps to protect motor vehicle drivers and others using the crossings. Oftentimes, safety measures such as fencing and warning signs were not installed along train tracks or in other areas that may be impacted by railroad equipment.

It is also possible for the railroad company to be held liable if those safety measures are not maintained properly. In another example, the crossing arm or alarms malfunctioned and did not warn an oncoming vehicle, which could have avoided a crash with a train. A train company can be held liable for accidents with injuries if the engineer fails to sound the horn when approaching a crossing.

How an Injury Lawyer Can Help

An injury lawyer who handles railroad collisions can investigate liability, such as the engineer, track or railroad company and others. Once liability has been determined, an investigation to collect evidence to support the client’s injury claim for damages is performed. The attorney can also handle negotiations with the insurers to try and achieve the best possible financial outcome for their client.

Liability Depends on the Train Collision Location

Railroad companies may be held responsible for injuries caused by employee negligence. For example, railroad workers may be liable for failing to maintain safety measures or warn of impending dangers that lead to an accident.
