Who May File a California Wrongful Death Claim?
Immediate families, such as spouses and children, may file a claim for a deceased person. Parents and siblings may be able to file a claim if the deceased did not have a wife or children. Instead, the estate representative may file, but only one lawsuit is possible.
Evidence in Wrongful Death Cases
Evidence that supports the wrongful death in a Sacramento traffic collision is necessary for a successful claim. It must be proven that another person or entity caused the fatality to pursue compensation. Attorneys can conduct a traffic collision investigation to determine whether the family has a valid claim. Documents such as police reports, footage from traffic cameras, witness statements, and other evidence help support the family’s claim.

- Burials and funerals can be reimbursed.
- Benefits such as pensions, insurance, and other financial support, such as wages the deceased provided, can be recouped.
- Survivors may seek compensation for loss of guidance, advice, love, protection, and moral support.
- Household services may have been provided by the deceased around the home, such as cleaning or repairs that can be recovered.
- The family may be entitled to punitive damages if the at-fault person acted maliciously or recklessly, which led to the loved one’s death.
