Highway 99 Off-Ramp Accident Occurs on Mack Road Exit

A pedestrian fatality was reported on July 28 after a man was hit by a vehicle on a Sacramento highway off-ramp. The accident occurred around 2:52 a.m. along Highway 99 southbound at the westbound off-ramp for Mack Road. The driver of the vehicle, a man aged 22, remained at the accident scene and was cooperative with the investigators into the crash, according to the California Highway Patrol (CHP)

Investigation Underway to Determine Cause of Off-Ramp Accident

The County Coroner’s office transported the body of the pedestrian while the vehicle was towed as part of the investigation by CHP traffic accident detectives. Neither alcohol nor drugs appeared to play a part in the accident. It is believed the man who was killed may have been unhoused.

Wrongful Death Claims

Evidence must be provided to support a wrongful death claim. In California, the immediate family member of anyone who dies in an off-ramp accident due to the wrongdoing or negligence of another may sue the at-fault person for damages. The deceased person’s estate may file also, but only one lawsuit is allowed.

Evidence Collection is Required in Wrongful Death Cases

An attorney can investigate traffic collision cases to determine if there is evidence in the off-ramp accident that supports wrongful death claims. Obtaining police reports, witness statements, medical bills, pictures of the accident scene and other documents relevant to the accident is essential. Expert witnesses can determine the at-fault party’s negligence and the cause of death.

The best way to make a successful claim for wrongful death is to contact an experienced lawyer as soon as possible after the off-ramp accident. It is important to ensure that all aspects of your case are considered by a lawyer who can assist in gathering evidence and evaluating its strength. As well as finding out your legal rights, you can also learn how to pursue a successful claim.

Compensation for Wrongful Death

There are several types of compensation that can be recovered in wrongful death lawsuits under California law, including:

  • Expenses associated with funerals and burials can be recouped.
  • A deceased person’s financial support, including pensions, insurance and other benefits, can be reclaimed.
  • There may be a claim for loss of guidance, love, protection, and moral support provided by the deceased.
  • It is possible to recover household services provided by the deceased such as cleaning or repairs.
  • An at-fault party may be liable for punitive damages if he or she acted recklessly or maliciously.

Wrongful death claims in California must be filed within a limited period of time. Only close relatives, such as spouses and children, can file a claim on behalf of a deceased person. When the deceased had no spouse or children, his or her parents or siblings may have the right to file a claim for the death.
