Young Boy Killed and His Sister Injured in Sacramento Freeway Accident

A Sacramento freeway accident happened on February 11 that killed a young juvenile and injured his sister as they stood outside their disabled car. The collision occurred at about 4:35 p.m. along Highway 50 westbound near 65th Street. California Highway Patrol (CHP) officers had received word that a Toyota was disabled and blocked the fast lane.

The mother of the youngsters reported that their Toyota had blown a tire, and she and her children had exited the vehicle because they felt unsafe. The accident occurred as CHP officers were heading to the scene.

Accident Investigation Underway by CHP Detectives

A male, 30, driving a Ford, was going west in the fast lane and reportedly tried to slow down but entered the median and struck the youngsters during the Sacramento freeway accident. K-rails are installed in that area to allow construction workers to enter the center median. The female minor suffered significant injuries in the crash, and the boy died at the scene. An investigation into the accident is underway by CHP traffic collision detectives.

Injuries and Fatalities in an Accident

When minors are injured or die in a traffic accident caused by a negligent driver, the parent or guardian may file a claim for personal injury or wrongful death. Although filing a claim will not ease their pain and grief, it can help them avoid financial problems and help the family obtain justice by holding the at-fault person responsible. We offer a free review of your case, can answer your questions, and help your family receive the compensation they deserve.

Personal Injury Claim Compensation

Personal injury compensation for a minor in California is the same as that for an adult and includes:

  • All medical expenses related to the accident are recoverable, from ambulance costs to hospitalization, physicians’ bills, surgeries, tests, and rehabilitation. The lawyer can factor in the additional expenses if the accident injury is ongoing when the case settles.
  • Wages lost because the individual could not work due to injury are recoverable.
  • Pain and suffering include the physical and emotional trauma the person experiences as a result of the Sacramento freeway accident.
  • An award of punitive damages is possible when the injury was caused by the at-fault party’s intentional act or egregious neglect.

Wrongful Death Compensation

Recovery of damages for a wrongful death includes the following:

  • Funeral and burial expenses
  • Anticipated earnings
  • Compensation for the child’s anticipated lifespan
  • Loss of love and affection
  • An award of punitive damages is also possible if the death was caused by the egregious or intentional actions of the driver

A wrongful death claim is explained in the video below by accident attorney Ed Smith:
