Roundup™ Claim Eligibility: What You Need to Know

Roundup™ claim eligibility can rest on a number of factors. As many of us know, Roundup™ is linked to non-Hodgkin’s lymphoma, and lawsuits are proceeding in the courts. However, many people are unsure about the status of Roundup™claim eligibility. This article will walk you through the reasons necessary to be involved in a lawsuit against Bayer AG, the company that purchased Monsanto in 2018. First, let’s review what Roundup™ is and how it is affecting humans around the world.

Roundup™

The chemical name for Roundup™ is glyphosate. Monsanto held all the patents on this compound in the past, and Roundup™ is the most popular brand. It has been used by farmers, custodians, and homeowners to keep weeds from growing. It is a non-selective chemical, which means it kills anything with which it makes contact. Because of that, in the beginning, farmers or others were only able to use it at certain times. If it was used once the plants started to grow, Roundup™ would kill the plants as well as the weeds. Monsanto devised a way to make the seeds for plants resistant to Roundup™ and sold the seeds to farmers. Now, the weed killer would be effective at any point during the growing cycle.

Roundup™ and Non-Hodgkin’s Lymphoma

In 2015, the World Health Organization (WHO) linked Roundup™ to non-Hodgkin’s lymphoma and other cancers. It was found that Roundup™ also leads to DNA mutations. This led many other countries to ban Roundup™. In the United States, the weed killer is still sold. The Environmental Protection Agency took public comments until the spring of 2018 and released one report in August calling glyphosate only slightly toxic to humans. As of August 2018, 8,000 lawsuits were filed by those with Roundup™claim eligibility, and one civil trial in San Francisco led to an award of $289 million to a groundskeeper who developed non-Hodgkin’s lymphoma. This established a precedent for others where Roundup™ usage led to the development of this deadly cancer and Roundup™ claim eligibility.

The Essentials of Roundup™ Claim Eligibility

In order to determine if you are eligible to file a claim against Monsanto/Bayer after using Roundup™ and becoming ill, it is important that you discuss your situation with a Roundup™ cancer lawyer. However, certain factors are found in most cases:

  • Exposure: Frequent exposure to Roundup™ increases your risk of cancer or other ill effects. This is found in people who regularly use the chemical such as:
  • Gardeners
    • Farmers
    • Grounds custodians both for public and private entities
    • Landscapers
    • Workers in the agriculture field
    • Herbicide applicators
  • Cancer diagnosis: Non-Hodgkin’s lymphoma is the most common form of cancer linked to the use of Roundup™, however, other types of cancer, including an increased risk of other childhood and adult cancers, have also been found.
  • Other health issues: The WHO found that other health issues were linked to Roundup™ such as:
    • Renal, pancreatic and skin cancer
    • Higher rates of childhood cancers
    • Placental cell damage 18 hours after exposure
    • Hepatic (liver) DNA damage after exposure to low levels of Roundup™
    • Neural cell death that can lead to Alzheimer’s and Parkinson’s

The Aftermath of Using Roundup™

For some, using Roundup™ may lead to a healthy crop or beautiful garden, but for far too many other individuals, it can lead to cancer or other problems. While developments are constantly being made in the types of treatment to combat these diseases, the illnesses still can devastate the sufferer as well as his or her family. In addition, the treatment itself may take a toll in terms of side effects. The expense of care may be astronomical and the individual might be unable to work. In the end, many patients may die due to Roundup™. This is preventable if the company acknowledges the risk potential of its product instead of claiming that it is as safe as table salt or water.

How a Sacramento Personal Injury Attorney Can Help

Filing a claim against Monsanto is, at least currently, the only way to be compensated for the pain and suffering you’ve experienced as well as income you’ve lost and the medical expenses that have accumulated. It is unfair to believe that the injured party should have to pay for the harm inflicted by a corporation that knew their product was unsafe but insisted it was non-toxic to humans. Corporations are lawyered up, and you should be too. An experienced Roundup™ cancer lawyer will investigate your claim, fight for your right to compensation and make sure the damages you receive are consistent with what you need and deserve.
