Accident on Riverside Avenue On-Ramp Injures Mother and Costs the Life of Her Child

A two-vehicle crash in Roseville on November 16 killed a minor child and sent the mother to a hospital. The accident happened along Interstate 80 at Riverside Avenue sometime before 9:00 a.m., according to the report issued by the California Highway Patrol (CHP). The woman and her child were riding in a sedan. The driver of the other vehicle was in a pickup.

Sedan Disabled by a Flat Tire at the Time the Two-Vehicle Crash Occurred

The sedan involved in the fatal collision was disabled on the Riverside Avenue on-ramp due to a flat tire when it was hit by the pickup. The injured mother was transported to Sutter Roseville Medical Center for treatment, and the driver of the pickup was taken to a hospital for care also. The accident is being investigated by authorities to clarify how the two-vehicle crash occurred and to assign fault.

Driver Error Responsible for On-Ramp Accidents

The National Highway Traffic Safety Administration (NHTSA) has identified driver error as the leading cause of accidents on highway on-ramps. In a new report, the agency says that many crashes are due to distracted driving and speeding.

Speeding Leads to Fatal Collisions

Whether it is at a crosswalk or on an on-ramp, the outcome of speeding is the same – the driver cannot stop in time to avoid a two-vehicle collision or a pedestrian injury. The impact of the collision leads to significant injuries or death. This is because a vehicle can withstand a crash with low impact, but at higher speeds, the car is more vulnerable and so are the people inside.

Pedestrians suffer the same fate. At low speeds (under 10 mph), the pedestrian’s injuries are more likely to be minor. Yet, at speeds over 25 mph, the impact will cause severe injuries or even death. That is why speed limits have been lowered across the country in urban areas.

In a lawsuit, it is possible to prove negligence if a vehicle is speeding. This is particularly true on highways and in construction areas. If a fatality occurs, the burden of proof is lessened if significant negligence is shown.

Distracted Driving Is a Common Driver Error on the Roadways

For many drivers, driving incorporates multitasking. Without a doubt, this leads to many accidents, some fatal. Drivers who take their focus off the road for as little as several seconds can fail to see a vehicle broken down in their path and slam into it. In this case, the distracted driver is at fault.

A personal injury lawsuit for damages caused by the negligent driver includes:

  • Medical expenses
  • Wage loss
  • Pain and suffering
  • Loss of enjoyment of life

Wrongful Death in a Car Accident

Losing a family member in a collision can be difficult for loved ones. If the deceased is a minor, the grief and anger they feel are exacerbated. The family grieves for the loss of the minor’s presence and needs closure. In some cases, criminal charges could be brought against the negligent driver. In addition, a wrongful death lawsuit can be filed against them by the parents. While this in no way makes their loss easier, it does help with financial difficulties associated with the accident and brings family members a sense of justice, knowing that the at-fault party will need to accept liability for the minor’s demise.

The following are some of the areas where a wrongful death lawsuit can reclaim damages:

  • Funeral and burial expenses can be recovered
  • Loss of the joy and love the minor brought to family members
