What You Should Know About Car Accident Cases

Motor vehicle collisions happen every day in Concord and across California. Each car crash is different as it may result in a wide array of injuries and damages. Most auto accidents are the result of driver error for reasons such as failure to yield the right-of-way to others, running a stop sign or red light, unsafe lane changes, texting and driving, and more. Any of these driving behaviors may be deemed negligence, and the at-fault party may be held liable for damages incurred through a bodily injury claim. These cases are generally covered by the insurance company representing the negligent driver. In situations where the driver responsible for the car accident has little to no liability coverage, there may be recourse available for injured parties through uninsured and underinsured motorist coverage. This type of benefit pays for accident-related injuries and losses up to the limits of the policy when it has been determined that the other side carried insufficient liability coverage or none at all.

In traffic collision cases involving overturned vehicles, it is essential to look into whether the injuries from the incident were exacerbated because of insufficient roof crush resistance. Automakers are held to high standards in the United States when it comes to the design, manufacturing, and safety warnings for motor vehicles. Failure to comply with Federal Motor Vehicle Safety Standard 216 on roof crush resistance may warrant an auto products liability case if the claimant’s injuries were exacerbated. Remember that the car in question must be kept and preserved for an experienced Concord car accident lawyer to examine with their team of experts. This is one of the many reasons why it is essential to retain legal counsel immediately following a motor vehicle crash. Unlike the other side, an injury lawyer is concerned with obtaining a favorable case outcome on behalf of those they represent to ensure that they are fairly compensated for their losses. How Much Time Do You Have to File a Personal Injury Case?

A strict deadline applies to injury cases arising from accidents caused by negligence in California. There is generally a two-year statute of limitations that applies to these cases. While this may seem like ample time, keep in mind that evidence that is essential to proving the case may be lost or destroyed over time. Conversely, the insurance company and defense counsel may make the recovery process challenging as they may resort to defense tactics to get out of paying fair compensation. For this reason, it is in your best interest to learn about your rights as a party injured in a crash caused by another driver by scheduling a free consultation with one of our skilled car accident lawyers at AutoAccident.com.
