The other individual in the vehicle suffered moderate injuries. Both were transported to a nearby hospital for further treatment and evaluation. An investigation into the cause of the rollover is underway by the California Highway Patrol (CHP).

Passenger Injuries When the Driver Is Negligent

When a driver is negligent, it can result in serious injuries to the passengers of their vehicle. Negligence occurs when a person fails to act with reasonable care and skill that a prudent person would exercise under similar circumstances. A driver’s negligence can also be based on their reckless or careless behavior behind the wheel. Examples of behaviors that could potentially constitute as negligent driving can include:

  • Drivers who are distracted by their phones, texting, notifications, etc.
  • The use of drugs or alcohol while operating a vehicle
  • The act of speeding or tailgating another vehicle excessively
  • Failure to comply with traffic laws, such as running a red light
  • Driving too fast or carelessly in bad weather (not paying attention to road conditions)

Injured Passengers Can Seek Compensation

Negligent drivers can be held accountable for their actions, as they have a duty to operate their vehicle in a reasonably safe manner. Passengers who are injured due to another person’s negligence in a rollover accident can seek compensation through filing a personal injury claim. An experienced lawyer can help those who have been injured understand the laws and assess their case to determine how much they may be entitled to receive in damages. People who were injured because of negligent driving should contact an attorney right away to begin the process of filing a claim and seeking justice.

Recovering Compensation After a Rollover Accident

Compensation typically sought in these types of cases include medical expenses, lost wages, pain and suffering, emotional distress, loss of enjoyment of life and any other applicable costs associated with the incident. It is important to note that California law places a two-year time limit on how long an injured party has to file a claim, so it is essential for those harmed by another person’s negligence to seek legal counsel as soon as possible.

Negligent drivers should be held accountable for their actions, and passengers who are injured due to such carelessness should not have to bear the financial burden of these incidents by themselves. With an experienced attorney at your side, you can fight back against negligent drivers and receive compensation for your losses.
