Rollover Accident Injures Two Near Fresno

A rollover accident along westbound Highway 180 and Clovis Avenue near Fresno left two parties injured on the afternoon of March 5, 2019. A sedan was traveling along Highway 180 when the driver reportedly lost control of the vehicle, causing it to overturn. Two parties were injured in the accident, including a woman who was reported to have suffered a head injury. Both parties were transported to the Community Regional Medical Center for treatment. Officials have not yet released an update regarding the conditions of those injured in the crash.

Common Injuries in a Rollover Accident

Rollover accidents are uncommon. However, their results often prove catastrophic. This is due to the violent nature of these crashes. Some of the injuries commonly suffered in these car wrecks include cervical sprain, crush injuries, bone fractures, spinal cord injuries, and traumatic brain injuries. These collisions may also result in a wrongful death in some extreme cases.

Determining Liability in a Rollover Collision

Whether a single vehicle accident resulting in a rollover appears to have been caused by unclear factors or by driver error, an experienced Fresno personal injury lawyer has the relevant resources and knowledge to help build your case. In nearly all motor vehicle accidents, it is crucial to not only determine what led up to the crash but also whether injuries were more severe due to the design of the vehicle. An experienced injury lawyer will investigate factors in rollover accidents such as defective vehicle parts or equipment, insufficient roof crushing, and overall susceptibility to overturning. Moreover, an attorney will look into whether tread separation or other types of tire defects caused a blowout or roadway defect that may have contributed to the rollover. To learn more about how fault is determined in a crash, watch the below video.

Recoverable Damages in an Auto Accident

A party who has suffered injuries in an auto accident involving a rollover may be able to file a personal injury claim against the driver or entity responsible for the crash. If the collision was caused by a negligent driver, that motorist would be financially responsible for any losses caused. Conversely, if defective vehicle design such as lack of roof crush resistance is to blame for the severity of the injuries suffered in the crash, the manufacturer may also be held liable for damages. These may include medical expenses, lost wages, disfigurement, loss of future earnings, loss of consortium, and pain and suffering. Since auto products liability cases are often difficult to handle alone, it is best to seek assistance from an experienced personal injury lawyer in Fresno.

Single Vehicle Accidents and Passenger Injury Claims

In a single vehicle accident where the motorist holds fault for the crash, passengers who were injured in the collision may still be able to bring a claim for their losses against multiple parties. These include the insurance policies of the motorist and the owner of the vehicle. Conversely, a passenger may also use their own automobile insurance if they have uninsured/underinsured motorist coverage. This type of coverage may only be used if the damages of the injured passenger exceed the policy limits of the at-fault driver. Even if the driver was a friend or family member, the injured passenger should not feel guilty for filing a claim or worry about ending a relationship.
