Police Seeking Hit-and-Run Driver in Roadway Accident

The seriously injured man, described as age 50, was taken to a hospital where he perished. No additional information was provided by the police. However, an investigation by the CHP traffic unit is underway to determine how the accident occurred and to locate the hit-and-run driver. The County Coroner’s Office does not release the name pending family member notification.

Wrongful Death Claims

In the event of a pedestrian death caused by the negligence of a motorist or another party in a roadway accident, immediate family members may be able to pursue a wrongful death claim. Whether wrongful death claims are supported by evidence can be determined by an attorney examining traffic collision cases. It is the lawyer’s responsibility to collect evidence, such as police reports, traffic camera footage, witness statements, and picture evidence of the accident scene. Moreover, expert witnesses can support both the negligence of the party at fault and the cause of death in the roadway accident.

The Benefits of Hiring an Injury Lawyer

Having an experienced wrongful death lawyer on your side is essential to making a successful pedestrian fatality claim. A lawyer can help you gather evidence and analyze its strength in order to ensure that all aspects of your case are taken into consideration. The information you receive can help you feel more confident about pursuing a successful claim.

Recoverable Compensation in a Wrongful Death Claim

California law allows the following compensation to be recovered in wrongful death cases:

  • Expenses associated with burial and funerals can be recovered.
  • It is possible to recover the deceased’s earnings, pension, insurance and other benefits that they received from their job until retirement.
  • As a result of the death of a loved one, family members may be able to make claims for loss of guidance, support, protection, advice and moral support.
  • The remaining spouse may claim loss of consortium.
  • It is possible to recover the cost of household services that the deceased provided such as cleaning, lawn care and repairs.
  • Punitive damages may apply if the party at fault acted egregiously or intentionally caused the death. These types of damages are in addition to others.

A claim for damages for the loss of a loved one can only be filed by close relatives such as the spouse and children. The estate administrator may also place a claim. However, the number of allowable claims is limited to one. A claim may be filed by parents and siblings if the deceased did not have a spouse or children.
