Second Driver Swerves to Miss Hitting Pedestrian

Later, another driver saw the pedestrian on the road, which caused the motorist to swerve to try and avoid hitting them. Sadly, the driver exited the roadway onto a residential property, suffering critical trauma. A juvenile also in the vehicle was unharmed. No additional details were released, and the time period between the first and second accident is yet unknown. An investigation is underway by the CHP traffic accident unit.

Searching for a Fleeing Driver in a Fatal Pedestrian Collision

Finding the driver who caused the fatal pedestrian collision is key to holding them responsible for their actions. We’ve been successful a number of times in finding fleeing drivers. Our investigative techniques are key in locating these negligent drivers. We look for surveillance cameras in the area, scout out the accident scene itself for clues and interview any witnesses to the crash. In addition, the police report is examined for any helpful information.

Using Insurance Coverage to Pay for Your Accident Injuries

Many Californians have insurance that covers uninsured or underinsured drivers. When you suffer an injury or a loved one dies and it was caused by a hit-and-run driver who can’t be located, you may use your insurance to help pay for your injuries. Even if the injured person does not have this coverage but another member of the family does, it can be used instead.

How Do I Know if My Family Can File a Wrongful Death Claim?

By calling, an attorney can review your accident case and determine whether or not your family can potentially file a claim for wrongful death following a fatal pedestrian collision. They can also answer any questions you might have and let you know what options are available to recover compensation. Accident attorneys work on a contingency basis, so when you decide to let an attorney handle your case, you owe them nothing unless your claim has a successful outcome.

Do I Have a Limited Time in Which to File a Claim?

Those who are injured because of the negligence of another person or entity in California have to file their claim within two years of the date of the injury. If it is filed late, the court will refuse to hear the case. There are exceptions to the law, such as medical injuries or if the trauma involves a minor. By contacting an injury lawyer, you can find out what law pertains to your case and ensure that your rights are protected.
