There were two men in the Honda, and the passenger in the vehicle died. The two men appeared to have been driving to work when the collision occurred. Investigators with the CHP traffic collision division are determining the fault in the accident and how it occurred.

Utility Trucks and Fatality Accidents

Large pickups modified to serve a specific purpose are commonly used as commercial utility trucks. Among their many uses, they are used for electrical work, tree trimming, television cable jobs, lawn maintenance, phone line repair and other jobs. A fatal crash involving a utility truck can be caused by the following:

  • Driver negligence is a major cause of a utility truck accident.
  • Because drivers of utility trucks are not held to the same standards as those who drive larger vehicles, they do not have mandatory breaks, so fatigue becomes a problem.
  • Utility truck drivers are not always trained to handle these larger vehicles.
  • Drivers make frequent stops, which can lead to a fatal crash involving a utility truck.

How an Accident Lawyer Can Help

An accident lawyer can investigate the situation to determine which driver was at fault for the fatality. They can then gather the evidence to support a client’s injury claim, such as interviewing witnesses to the accident and reviewing the police report for errors. In addition, the lawyer can look for area surveillance cameras that may have captured the collision and perform accident reconstruction. Accident reconstruction illustrates the positions of the vehicles before the crash and shows how it happened. This evidence is accepted in court and by insurance companies.

Once all the evidence is compiled, our injury lawyers use it to construct a strong case that benefits the surviving family members, who use it to file a wrongful death claim.

Damages That Can Be Recovered for Wrongful Death

In wrongful death cases, compensation can vary from family to family based on a variety of factors, such as income and age of the decedent. The following are common areas to include, however:

  • Funeral and burial or cremation costs are recoverable.
  • Wages the decedent would have earned until retirement age, along with bonuses, insurance and pensions, can be compensated.
  • In addition to loss of consortium, a spouse may also claim loss of emotional support and love.
  • Guidance and nurturing may have been lost to children within the family and can be compensated.
  • In addition to lawn care, tax preparation and other household services have been lost and can be compensated.
