Pedestrian Fatality Occurs at Norwood Avenue Intersection

A traffic collision in North Sacramento claimed the life of a pedestrian when he was struck by a motor vehicle on February 11. The accident occurred at the Norwood Avenue intersection with Berthoud Street around 5:52 a.m., which is when the Sacramento Police Department received a report that a pedestrian had been struck. Upon arrival, they discovered the pedestrian had sustained major injuries.

Vehicle Driver Cooperates With Traffic Collision Investigation

Although the injured pedestrian was transported to a hospital after the traffic collision, he died later from his injuries. The driver of the vehicle stayed at the scene and cooperated with investigators into the cause of the fatal accident. The deceased pedestrian’s name will not be released until the family has been contacted by the Sacramento County Coroner’s Office.

Filing a Wrongful Death Claim in California

If the family of a deceased pedestrian wishes to pursue a wrongful death claim in California, evidence is necessary to support it. Under California law, any person who dies because of the negligence or wrongdoing of another party can be held liable for damages. Furthermore, if a pedestrian is killed because of an at-fault driver in a traffic collision, their family may be able to collect damages for the loss of their loved one.

Evidence Collection to Support a Wrongful Death Claim

In order to prove a wrongful death claim, an attorney can investigate the traffic collision case and help identify evidence that supports it. This usually includes gathering records such as police reports, witness statements, medical bills, photographs of the accident scene and any other relevant documents. In addition, expert witnesses may be called upon to testify about the cause of death and negligence of the at-fault party.

To make a successful wrongful death claim in California, it is important to contact an experienced attorney as soon as possible after the accident. An attorney can help gather evidence and evaluate its strength to ensure that all aspects of your case are accounted for. They can also advise you on your legal rights and the most effective strategy to pursue a successful claim.

Recoverable Damages in a California Wrongful Death Case

California law also provides for a variety of other recoverable damages in a wrongful death case, including the following:

  • Funeral and burial expenses
  • Loss of financial support that would have been provided by the deceased
  • Loss of love, guidance, protection, advice and moral support the deceased would have provided
  • Loss of household services, such as cleaning or repairs that would have been provided by the deceased
  • Punitive damages might be available if the at-fault party is found to have been reckless or malicious in their actions

It is important to note that California law limits who can file a wrongful death claim and how long they have to do so. Generally, only close relatives – such as a spouse or children – are eligible to file a claim on behalf of the deceased person.
